Can they garnish me if I go bankrupt? - Idaho law?
I had a judgement rendered against me in the state of Idaho in October 2008 from a collections company. and just recieved notice that I will be having my wages garnished. I know they can take 25%, but if I go bankrupt can they continue garnishment because of the judgement? my friends says they can. because I have been legally ordered to pay that amount back. Help!!!

Its the collections company, they are having the state of Idaho deduct the payments directly from my paycheck and giving it to the collections group.

some judgments can be discharged in federal bankruptcy filings but some may not even civil judgments may not be discharged at all. Seek an atty in your area that specialty is BK law--Yellow pages best place to look.

I don't think so, presuming you're filing Chapter 7. The point of filing bankruptcy is to prevent them from garnishing wages, etc.

Look up local attorneys specializing in bankruptcies...most will give you a free initial consultation. Take the judgment with you to show them.

Best thing to do is get yourself a really good bankruptcy lawyer. They know that you are broke and won't charge their whole legal fee up front. I did it 7 years ago after the same thing and my credit has never been better. Best to declare bankruptcy and get a clean slate

No, if you charge off the debt through bankruptcy, they can't collect it. Just make sure it's included in your bankruptcy, even if they have sent it to collections.

depends who is garnishing your payment... if you're talking about gouvernement yes , otherwise ask a lawyer

If I am correct and you claim this debt in bankruptcy then it should be discharged. The best is to talk to a bankruptcy attorney.
