Can we be turned over to collections even if we are making some sort of payment a month on the account?
There's a school account that we verbally agreed to make a monthly payment on for a certain amount. We fell short this month due to extra bills piling up so we made a payment that was less then what we agreed on, just to make some sorta payment. They called today and basically said the payment we made was unacceptable and they were going to forward our account to so-n-so. Can they do this?? This is the first time we've had to resort to this!

Yes, they can. They were kind enough to give you a payment plan and you defaulted. They can turn you over to collections or even take you to court.

It is an urban legend that as long as you pay something a creditor has to accept it and can't sue.

You should have called when you realized you were going to be short. They probably would have worked with you. It is always better to be up front with creditors.

Sorry to tell ya but yes they can. I know it sucks. I am kinda in the same place. One thing that i did was get another credit card that had a 0% ballance transfer rate. That way what you pay all goes towards the total amount and not interest. Try freecreditcardsforyou.com they have tons of 0% transfer cards and alot are for a year and do not have a anaual fee

I think so. you should have called them to tell them that the payment would be lower, try to call them again and ask if you could speak with a supervisor

If you agreed to a certain dollar amount to be paid monthly and you did not meet your agreement then yes your account can be turned to a collection agency. If the account is placed for collections you can, a. contact the original creditor to try to work out a new payment plan, or b. pay thru the collection agency. Remember, a collection agency can not hassle you at your place of business if you tell them not to call. You can also write a cease and desist letter to the collection agency that you do not want them to contact you by phone, mail, or any other means to collect this debt and continue making your payment to the original creditor. Just make sure and keep all receipts that you have made your payments.

The account may be sold to collections because of the fact that this was a verbal agreement. May I suggest that from now on, every financial agreement you enter into should be on paper.

Yes they can turn your account over to a third party collector at any point in time. But fear not, you can actually get better payment arrangments with 3rd party collectors because they purchase your debt for literally pennies on the dollar. If they are not willing to accept some sort of money compared to nothing, then tell them to go ahead and send them to collections, you can work with them a lot easier then the original creditors.
