lisamarie7901 | Can you file bankrupsy with out using a attorney? |
|

Yasmin

nope, cuz ur taking it to court....love ur name!! |

Most likely, but if you've got any assets worth $10,000 or more in total, you may be wiser consulting an experienced bankruptcy attorney. |
|

littleman
 |
yes, you can. It's a good idea to at least hire a legal secretary to help with the paper work, but you would save money. |

YEAH YOU CAN REPRESENT URSELF, BUT IT WILL BE A LOOOOOOT OF WORK |

Yes, you can but you have to know all the ends and outs of everything. Its a huge legal thing so there is alot more to it. You have to have all the paperwork and all you credit card reports that they sent you and collection bills. I would just save and get the attorney. |

This is a complicated matter to do by yourself. You also have to send all your creditors letters of your intent to file bankruptcy. You will have to represent yourself in federal court. Here is a link to show you what all is involved. If you screw it up, you can still end up owing your creditors and end up costing you more than it would be to get an attorney to do it for you. Even though this is probably not your state, it does provider links for other government information links to file.

Although it may be possible, the amount of paperwork that needs to be filed, as well as negotiations with your creditors, assessment of your personal value and belongings.....very time consuming and emotionally draining.
if i may suggest.... make a call to your creditors...not the collection agencies..but the actual places you owe money to. inform them that you are in dire straights and require some lee way on the timetable of your re-payment.
10 years of bankruptcy is no joke...it will eliminate you from many potential job possibilities in the future. Law enforcement, government, financial, IT...you name it..there are ramifications..
Inform the individual who is wishing to declare bankruptcy to contact a credit counseling agency..to assist them in managing the repayment schedule of you debt.
good luck.. |

Yes you can, but be certain you use the correct spelling. |

It's a big case. You have to get a law practices (Lawyer's business) to file your application in high court. Bankruptcy use to be in High Court not at the Magistrate Court or Session Court. |

You can but it is suggested to get at least some sort of legal advice before filing for bankrupsy because of the effects this will have to your credit rating and other financial issues (even the simple ones like opening a bank account). |

Recent passage of the Bankruptcy Prevention and Consumer Protection Act (http://thomas.loc.gov/cgi-bin/bdquery/z?d109:SN00256:|TOM:/bss/d109query.html|) in April 2005 has also resulted in major reforms in bankrupcy law, outlining revised guidelines governing the dismissal or conversion of Chapter 7 liquidations to Chapter 11 or 13 proceedings. The law also expands the responsibilities of the United States Trustees Program to include supervision of random and targeted audits, certification of entities to provide credit counseling that individuals must receive before filing for bankruptcy, certification of entities that provide financial education to individuals before being discharged from debt, and greater oversight of small business Chapter 11 reorganization cases.
So the answer is no. Even if you could navigate all legal jargon, the required paperwork, and the courts on your own, a person filing bankruptcy is now required to have counseling first. If you are considering it, you need an attorney to work all the angles and get the best legal verbage for your individual debt situation. |

Yeah, with your spelling it would be best left to an attorney. Some things you can do on your own, and your willingness is admirable, however..I'd leave BANKRUPTCY to those more knowledgeable. Good luck! |
