Well its not always best to take that route some cash advances will go to your house and look for you. But don't be too worried most of them don't. When your checks come back or check comes back to the store it is consider delinquent it will not raise interest depending on where you go. After 60 day if you have not made any payment it will got the personal attorneys and they will deal with it. Can you tell your friend its not nice to borrow money and not pay it back :)

The interest accumulates at an extremely high rate, and his credit rating will go to hell. Collections agencies will get involved and then small claims court, but luckily there are no debtors prisons yet in the U.S. Although they will garnish his wages.

it will cost him more if and when he pays it. under 500 is a misdemeanor here, so you get a ticket and a court date. you cant squeeze blood from a turnip

well they directly deposit and most banks that I know will pay it and charge fees so maybe all he will have will be fees and if dont cover the bank he could get into serious trouble with bank

What company is the advance through? Depending on the company, some may not even be allowed to prosecute your friend if they are a part of the CFSA.

Obviously, he will have to pay the late fee's, etc. However, it is still a great idea to call the company first and check with them so they do not feel he is trying to run.

If he gave them a check, and they try to deposit it and it comes back with Insufficient funds, that is the same as fraud, and yes he can be arrested for that. If he closes the account that is even worse because that is deliberate and intentional fraud. A warrant can be issued for his arrest, and trial. That will include fees, penalties, court costs, and of course the bank will charge overdraft fees. Payday loans are a revolving debt that is hard to get away from, if you do not have the money for your bills, how or why do you think you will have the money plus the high interest rate and or fees associated with them in 2 weeks.

I'm not sure if he could go to jail, doubtful. Those check advances are such a racket! They should all be shutdown. They just make your situation even worse. He needs to call or go to the place & try to explain the situation & work something out with them. It worse if he just doesn't pay or contact them.

First they'll send him to collections, then they'll prosecute. This is their business, so you better believe that this happens all the time, and they have a loss prevention team in place in each state to file charges, prosecute, and get their money back.

The answer is if, and ONLY if they can prove fraud on his part. That's extremely hard to do. Of course that doesn't mean the advance company won't threaten him with legal action, but it's pretty much an empty threat.

Remember, debt is ALWAYS a civil matter. It only becomes a criminal matter if there is fraud involved.

No. He didnt commit a criminal crime. So I would say NO. The only thing that would probably happen, depending on the state and how strict they are with this certain situations, would be they will either take you to court for the money and you will have to pay it or they will report to your credit report and you will continue to get harassed by collection agencies until you pay. There's nothing criminal in not paying back a loan.

Yes you can go to jail. He must contact the place right away and make payment arrangements. Also, he might want to retain a solicitor as he will have arrest warrant. They will probably send someone to his home to look for him, and also file a report with local law enforcement. They will then attempt to locate, detain and arrest. Bail will probably be at least amount he owes, and when he goes to court, he will have more fees.

yes you could [ but you canget out of that that phone them tell them about the monry troubles you are having and that you can only pay so much back a mouth thay have 2 accept it cos your be willing 2 pay back something nothing will happen 2 you , dont worry jail just phone explain and thay have 2 accept what you can aford, i have been there so i no what your going throw not nice but you can keep them off your back by offering them money, then no one can get you . dont worry, just do that and you will feel better, good luck
