Capital One?
My partner has an arrangement with capital one to repay his credit card at x amount a month. Although this is in place he is getting phone calls constantly pestering him for the full amount. He had three over the weekend the last being Sunday evening(nice time to ring). I think it is harrasment, has anybody else had a similar experience and are they within their rights to bully like this?

Copy and paste the letter below to them, ASAP:

Dear Sir/Madam,

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.

I now require all further correspondence from your company to be made in writing only.

I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

If you continue to harass me by telephone, you will also be in breach of the Wireless Telegraphy Act (1949) and I will report you to both Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

Be advised that any further telephone calls from your company will be recorded.

Yours truly,

Add your name, address, Cap1 account number, and send off.

Don't worry if you can or can't record the calls, they don't know whether you're bluffing or not.

If it's been passed to the debt collectors, you can bet part of your outstanding balance will be down to charges, so send off a S.A.R - (Subject Access Request) to Cap1 ASAP.

A friend of mine "owed" Cap1 £500, on receiving her statements, it turned out that there was £600 of charges, so they owed her £100!!! Like you, she was gettign harassed all day long, I got her to send the letter above, and they confirmed in writing they would stop calling, and they haven't called her once since.

Capital-One is defiantly the most annoying company. I have no credit cards but they send me so much junk mail. They will harass him but voice mail or answer machines are great for this. I believe there are laws to stop it but it ain't worth the money. Can he get out by going with another company or consumer help.

No never, i had a capital one card and they kept phoning to ask if we wanted to upt the amount, we got that sick of it we paid it all off, now they continue to phone us. Thank god i no longer have a credit card........

Tell them you have a payment arrangement and have been holding to that arrangement and then tell them according to the FDCPA you request all communication to be in writing only. They must accept or be eligible for fines of 1K per call. keep a record and report them if needed.

the collectors are from a 3rd party company complied of jerks and *******. Call capital one tell them that since you have made the deal to pay them back and they approved it the collectors they sicked on you will not stop, they will have to call them off. If they dont I would call the local police and file a harassment charge, you have to proof from capital one that you are paying your bill. Or you can just change your phone number and unlist it.

You need to find exactly who it is that is calling and send them a cease and desist letter

type "cease and desist letter" into yahoo search and you will find many good examples

heres a secret capital one dont have a debt collection agency...they are their own debt collection agency! they just answer to a different name!!! usually debitas or something like that. You need to ring them and be firm, tell them you will stop paying them if they continue to call you. tell them that you have stuck to the arrangement so far and will continue to do so if they stop harrassing you. dont ask them, tell them, be firm its the only way. these people are trained to be ruthless, and to get as much money as possible. give it them back.

just tell them plainly that you have made an arrangement and to stop phoning you, warn them you will complain about harrasment, and ask them to make sure it is noted on your account that you have made such an arrangement.

if this doesnt work, send a letter of complaint to them. I had a similar problem with another company - the call centre staff were enjoying me getting pi55ed off so put the call through for another callback instead of marking it as resolved.

A phonecall to their complaints mob should gget it sorted pretty quickly. If not go a step further and complain in writing.

They are within their rights to call you if you havent made contact - but he has - so it should be noted in the account that he is doing something to pay it off.
