I'm finding I can't afford the payments to Capital One anymore. I owe them a total of $4900.00. I've called them and asked them for a lower interest rate and they stated I'm at the lowest, they can't help me. I've called asking them can I get a lower amount each month to pay off the bill? They stated no, that they could give me a ONE time hardship where I wouldn't have to pay them the one month. That won't help at all. I'm thinking about not paying them. What can happen? They will call you for about 3 to 6 months and threaten and harrass you. Then they will send it to collections which usually doubles or triples the original amount (due to fees).
Then collections will call you and harrass you. Of course, your credit will be shot.
I do not know if they will send you to court - the amount seems large.
Your future employers will do a credit check and not want to deal with people that can't handle finances. Landlords will not even give you the time of day unless you pay 6 months up front.
Good side. This whole process can be wiped off your credit history in about 10 years.
Debt relief places will take your money and never pay your bills. There was a lady here yesterday that paid 3,000 and the agency never paid her bills a single penny. It was CareOne. I've heard of others that are scams too.
If you feel you can live on a cash basis for 8 to 10 years you might consider living through this. Hope you do not move or have to apply for a new job. |

Contact your local Red Cross for a referral to the local Consumer Credit Counseling Services (CCCS) in your area. They can negotiate much lower payments and interest rates. They DO NOT negotiate settlements.
They will require you to stop using all credit and to cut up your cards. Your credit report will be updated to "enrolled in debt management." This does not damage your credit, but it may make it impossible to obtain new credit while you are enrolled in their program....so don't use this service if you anticipate applying for a new apartment, car loan or mortgage anytime soon, as you would probably be denied while you're enrolled in the CCCS debt management program.... Otherwise, it can be a very good way to deal with your debt. |

Ditto to a lot of what others have said. I have Capital One Platinum and have generally enjoyed their card. I know how you're feeling about this. If you have a good relationship with a family member or good friend, ask them about helping you out. Potentially they could pay the bill off, and then you could pay that family member in monthly installments. That would kill problems with Capital One.
Call Capital One, talk to anyone and everyone until they agree to lower your monthly payment or interest rate. From their end, it may be tough to lower any more due to the current credit crunch. |

Honestly, Capitol One SUCKS! They are the one credit card company who will give a credit card to anyone!
Their interest rates are insane and they charge you yearly fee's for just owning the card.
I had not used mine in over 6mths but got a bill in the mail for like $45 a few months ago.
I would cancel your card and pay little by little. They cannot go after you for that, as long as your making some effort to pay your bill thats all that counts.
If anything, you could always go to the bank for a loan to pay off the card and get a lower payment and interest rate through them which is what a friend of mine did. |

I can't tell you what they would do, but I can tell you what happened to me 9 years ago. My debt was $20,000 (I had money at the time but lost it all in the dot com bubble!), and my finance charge jumped to $500 per month! It was with a different card company. But they wouldn't lower the rate either and there was no way I could afford $500 in finance charges alone! So I asked people where I went to college, and they all said the same thing: don't pay the credit card and they will eventually call you to settle the account. So that's what I did, stopped paying them, and they didn't send me to collections. They realized after three or four months that I wasn't going to pay and they offered a repayment plan and lowered the debt. I paid $14000 over 2 years at no interest.
The interesting part is I probably paid $2500 in interest charges before I decided to stop paying. If I had to do it all over again, I would have stopped my payments earlier and not paid the extra $2500. (Actually, I wouldn't have charged that much and gotten into that situation if I had to do it all over again!)
I would have rather worked with them and have the interest rate lowered and paid the whole debt. On a side note, the $6,000 they forgave was counted as income on my taxes. And the settlement was on my credit report for 7 years from when I made my last payment. But at that point I didn't care, I'd rather have it on my report for 7 years than try to pay it down for decades. I no longer carry a credit card balance, by the way...
Think about it from their side. They're trying to get as much as they can, and as long as you're paying, why would they lower the rate and get less money? They will work with you only when they see that they're no longer getting payments. At that point they'd rather work with you and get as much money as possible rather than sending out to collections and paying the collectors a portion of the fee. Even if they sent it to collections, the collectors will most likely try to settle the case. The last resort is suing you, why would they go through that expense if they could set up a payment plan with you? SOOOO... to answer your question, the worst that could happen is you get sued. But there will be lots of steps before then so the chances of being sued are very low if you're willing to work with them.

**Edit: I have to say I also agree with Elizabeth, there are also ramifications to your existing credit. It will be much more difficult to get credit for the first couple of years after a settlement. |

well butI don't know what your financial situation is, but here are some ideas that might help. Can you sell stuff on ebay? You would be amazed at what sells, and you would not have to sell much to pay the minimum on this debt (what is it, about 100/month?). Can you cut expenses? Sometimes the cell phone company will let you freeze your phone for a couple of months - no payments but you haven't broken your contract. You could cut cable if you have it. Get a second job? Babysitting, housecleaning, helping an elderly person prepare the house for winter all these jobs could help you make a little extra that would let you pay the minimum.thanks |

First, when you are late on your payment they will report it to the credit agencies and your credit score will go down. When your credit score drops, any other credit cards that you have will automatically raise the interest rate you are paying. So you could end up having to pay more on your other debt. As your payment gets later and later your credit score will continue to drop, making it difficult for you to get a car loan, buy a house, or even get certain jobs.
Eventually Capital one will give up and sell your account to a collector who will call you night and day trying to get the money out of you, and adding fee after fee so the amount you owe continues to go up. Eventually you could be sued in court and your wages garnished to pay this debt.So, the outcome is not good if you fail to pay this debt.
I don't know what your financial situation is, but here are some ideas that might help. Can you sell stuff on ebay? First of all you shouldn't have gotten so deep in money problems. However, you could let them take you to court and have a judge set a certain amount to pay them monthly, capital one is NOT gong to be happy about it, butit will all work out in the long term. |
