Dont be a dang FOOL and try to get out of debt by filing 13 or bankruptcy! filing 13 will get them off of your back and give you payments but if you miss them you will be dismissed and lose everythang anyway. court orders are NOT removed from credit reports. Court Records are a matter of public record and can not be expunged from credit reports . dont let no slick lawyer tell ya an easy way out is filing!!!
It would be better if you didnt pay and got the cards charged off.these WILL be removed from credit records in 7 years . court records dont get removed.... sorry! |

If you go bankrupt, file your bankruptcy under Chapter 13. Chapter 13 permits an US resident to reorganize and restructure their finances. It allows you start afresh and get your finances back on the track. The bankruptcy court will supervise and authorize the entire process of overhauling your financial situation.
While filing for bankruptcy under Chapter 13, you have to draw up a plan of action meant to pay your dues within the next 3 to 5 years and submit to the bankruptcy court. You should clear your dues as much as possible at frequent intervals. Filing under Chapter 13 will protect you against the undue pressure exerted on you by your lenders to pay your debts. |

Well, if you are willing to set up a payment plan they will generally work with you and you won't lose your credit and everything else. There are tons of FREE gov. agencys that can help you. I don't mean to get all moral on you here but it is better if you do pay it back and not just for society, in the long run better for you knowing that even though it takes time you did the right thing........JMO |

A Ch. 7 Bankruptcy is a discharge of debt but now has income limitations. A Ch. 13 allows you to repay a portion of your debt over a period of time (36-60 months) and discharge the remainder of your debt. |
