I began dealing with Franklin Collection Services out of Tupelo, MS a little over a month ago after running a credit check and finding that my husbands ex had defaulted on an account that she had opened with his SSN. After giving her the option to pay up or be reported for identity theft, she paid us and we paid them in full. When I talked to them to start with they were oh so nice and promised me that I would get a letter of satisfaction when the account was paid. Well, today I called back to follow up on that letter and was told that it was a $5 fee for that and they were no longer very nice. So, lets see - I was the victim of identity theft, I was promised the letter and I got the account resolved for them and they want to charge me $5 for a receipt??? Is this legal? It certainly isn't good business. Any ideas on how to get this letter that I certainly feel I am entitled to without being duped for another $5? I just want something for my files to show that things have been taken care of. |

It's a collection agency... they'd probably been harassing you to pay for a while now. They'll get all the $ they can out of you for the time they had to spend to get paid. It's probably not illegal.
You should've just reported her for identity theft, would've been easier. |

It's worth the $5....
In the future, get any written agreement about settlements BEFORE you pay them, not after.
If the defaulted account is a credit card account....paying off the account won't magically fix your husband's credit....paid charge-offs are still negative items on a credit report and can stay for up to seven years. |

You probably paid by check? Your check would be your receipt. Don't ya just love it when companies like that send you such warm fuzzys? I'm glad I don't have to deal with them. Thats awful! |

More than likely the company that they were collecting the debt from is charging them a fee to get this information for you so they in turn pass that fee off to you. What you need to do is see what the status is on your credit report, see how it's listed on your credit. Either way it's going to look bad on your credit report because after all it was paid to a collection agency. Once you have a copies of your credit reports write to them and have them dispute it and make them change it as long as you can prove that the account was opened based on identity theft. You can also try writing them and see if they will send it to you, pick words that will get the person empathize with you not think that you're guilty and just being a pain.
However I am questioning why you wouldn't go after her regardless for the identity theft and make this her legal responsibility to clean/clear it up. |

Collection agencies are not known for being nice or honest. Never trust anything over the phone. Get every agreement in writing!
Pay the 5.00 and be done with it. It's worth it for your peace of mind. |

well - I know it's the principle of the thing...but $5 in the long run isn't worth the hassle.
Before you get up in arms...ask them why they charge for the receipt. If it's to pay paper or postage fees, see if you can arrange for it online so you can print it.
If they don't disclose the reason for the cost and you refuse to pay for a receipt (I would...I'm just that stubborn) I'd threaten to report them to the Better Business Bureau. The threat may be enough. |

I hope you went to the police and filed a report and mailed copies of this off to each CRA. This way, the negative entry that your husband's ex caused on his credit report can be wiped clean and you wouldn't need a letter of satisfaction. |

your husband's credit is going to take a hit for the next 7 years, and you're worried about 5 bucks? see, as far as the collection agency is concerned, your husband owes, the cash, not the ex. he should have reported her for identity theft. once a police report was filed, he could have used that to get out of responsibility for the debt entirely. now, that he has paid the judgement, his credit will be damaged, not hers...as it is his SSN. next time, he should contact a lawyer before satisfying the judgement. no matter what the collection agency says. after all, they just want the money, and they don't care who it's from. |
