I recently received a letter in the mail from a collection agency saying I owed $6,000+ for an old credit card I used to have. I looked at all three of my credit reports and that credit card is not even listed and there is no listing from collection agency. I'm fairly certain I never finished paying the card but the was years ago....and from looking at my credit reports, it looks like the charges were written off and removed from the reports. Can they still try to collect if the card isn't listed on any of the credit reports? |

Actually, Honey, that is what they will use to collect that debt. Collection agencies "buy" your debt from the creditors for pennies on the dollar. They are now your new creditor. If you don't pay off, they WILL add it to your credit report. They will continue to mess with your credit rating as much as they can and as long as they can until you pay it or settle. If they STILL can't get you to pay, they can sue you for it in court. If they get a "judgment" against you, that is ALSO entered into your credit report.
Thank your lucky stars that this isn't already on your report and do what you can to keep it from getting there. Also, don't be surprised if, even after you pay it, something shows up later. The credit card company may have already reported it to the credit agencies as going to collections. That sometimes won't show up on your report for up to 6 months. |

Be careful. There are "zombie" collection agencies.
Generally speaking after 7 years all debts fall off your credit report. Sometimes after this date the creditor will sell the account to a collection agency for pennies on the dollar. Then anything the zombie collects is almost pure profit for them. But worse, should you pay (or even talk to the agency) you restart the clock for another 7 years.
In some cases these zombies will sell the account to each other in an effort to restart the clock (get it reposted to your credit report as if it were a new debt) with the new collection agency contacting you again in an effort to get you to pay.
So if the debt is more than 7 years old, ignore the collection agency, do not contact them or the 7 year clock will be restarted and the debt will once again appear on your credit report (re-aging an account). Check out the Money Magazine forum website for additional information |

They can try but if it has gone to "write-off" then don't pay.If it is not on your reports anymore then keep it that way. IF you pay then it will start showing on your credit report again and lower your score. The bank has sold the debit and given up. This new company is going to try to get anything because that is profit to them. Don't reply to any of the letters. |

Ignore it. If the credit card no longer shows on your report that means it's been over 7-years since the date of first delinquency.
This means that the statute of limitations has run out and there is nothing they can do to you legally. They can not sue you in court so they can not get a judgment. Without a judgment there is no way for them to force you to pay a cent. |

Check your state, credit card debt falls under "open accounts"
If the statute of limitations has lapsed, the only thing they can do is hound you. They CAN NOT SUE. the statute runs from the date of last charge or date of last payment.
If you find that this account has truly lapsed the statute, then send them a letter to "Cease and Desist" but only send this letter if you are completly sure that the statute is up, because if it is not, they will sue you for the money.
Next, pull you credit report, if it shows on there anywhere and it is over 7 years fomr the date of last charge or paymnet, dispute this with the credit reporting agencies.

Yes, the statute of limitations is usually 4 years even if they never reported it to the Credit Bureaus.
However you should pay your bills. When you don't pay, it makes prices go up for all of us honest people.

What ever you do DO NOT PAY. There is a loop hole that if you pay even a little it can ressurect the debt and then the entire debt will then show up on your credit report again
DO NOT PAY. Then ask them nicely not to call and if that doesn't work you actually can have them put you on a do not call list as they propably bought the debt that was written off so that you do not even actually owe them good luck just dont pay or even talk to them !!!!!! |

You have to pay. It is in your credit report. If you just got one of those freebe credit reports they will not show you everything, you will actually have to pay for one. If you keep holding this off, they found you now and don't be surprise you if you get summoned to court for this matter.(It happen to me). I would make contact with them and let them know you can't pay the whole thing off. You can negotiate what you actually pay for the $6000. Good luck to you. |
