im like $1000 in debt, im still going to school so its difficult for me to work and actually pay my debt.
i got a phonecall from a creepy guy this morning talking about a lawsuit or whatever. i know its serious, but i was just wondering exactly what happens to me if they decide to take any action against me.
i think he was a normal bill collector, but he just sounded super mean/serious to try to convince me to pay becasue after he tried sounding all serious like the whole company hated me, he started going back to the routine questions that the bill collectors usually asked. |

You will not go to jail over $1000. I work in the legal field. If the collector is being harrassing you have a right to tell him not to call your home anymore. Tell him to contact you via mail. Do not give him your work number or cell number. What I would do is call the credit card company and offer to make a settlement. Tell them you just don't have the money and you only have $__ amount you can pay toward the debt. Collectors are scum and they will bully and harrass you and make you think they are allowed but they are not. Please look at these links I am sending. The first one is what collectors ARE NOT allowed to do. The second link is how to get a bill collector off your back. You can send a letter, etc. The last link tells you about the Fair Debt Collection Practice.
I have been in your shoes and it can be horrible but remember that you can settle this debt or tell them your financial situation. Don't rack up anymore debt either!!! Good luck. |

By law, bill collectors can say some things and there are some things that they cannot say to you. But all of them try to make you feel lower than dirt. Their purpose is for you to pay them in full so they can get their commission (it's their job so they need money too so they will say nearly anything to convince you to pay). If you don't pay then you are sued in court (at which time you appear and make a payment plan to get them off your neck) or they wait till you have income and garnish your wages and embarrass you in front of your boss. If they are mean and nasty they can also take it further in court if you don't even try to repay, they can put a lien against your car, and if you live with your parents they can put a lien on their house or car...and force you and/or them to sell those items just to pay your bill. So it's best that you set up a payment plan with the company or in court (not with the collector). |

The reason collection agents get away with what they are doing is because most people do not understand their legal rights.
The Fair Debt Collections Act was pass to prevent collection agents from abusing and harrassing debtors. So take the time to read up and learn how to fight back against these jerks. |

They could take you to court and garnish your wages BUT with only $10K, I am not too sure that they would do it.
Credit cards are unsecured loans therefore they have limited recourses to put liens on property you own. Most likely since your account is already with a debt collection agency, they will just keep bugging and bugging.
Normally these collection agencies are very agressive when it comes to collecting money for those delinquent accounts.
My suggestion do a google search of an organization (non-profit) called Consumer Credit Counseling Services. These companies can give you excellent advice and counseling. |

I work for a bankruptcy law firm and we have clients like you all the time... credit card companies will bug you and bug you until you pay and if you are working, they can get a court order to garnish your wages for the money you owe or go after your bank account. And worse, they can slap on more fees for taking you to court and attorney fees and however much interest they want to add on. They can get a judgement against you and worse case scenerio, they can take your possessions like your car...I have seen it go that far. |

sophieb said everything right except the part of doing stuff with your parents property. If you are over 18, you are your own person. No one can come to your parents and say your kid owes me money so I will take your stuff away.
They cannot put you in jail. They will (like what they did to me) take you to court and if they get a judgement there will be lean on anything you own, if not it will go on your public record and credit report. But this only happens if you owe a good amount of money. I have never seen anyone taken to court for having $1000 in debt. It will cost more for their court/lawyer fees. But there are always exceptions.

Usually not. Some people will get a credit card and run up the bill with no intention of ever paying it. This is fraud and is punishable by jail. But it's hard to prove and rarely happens. Cut up your credit cards, make a deal to pay off your debt a little at a time without interest eating up the whole amount, and write the company a letter informing them you want no more phone calls. This is your legal right. |

Yes. Because of all the people who aren't paying their credit card bills, house payments and car payments, etc... the Bush Administration quietly passed a law that is opening up Deptor's Prisons for people who don't pay their bills. The law took effect on July 1st, 2007
This was common in the 16th thru 18th centuries in Europe and it was so successful, George Bush is starting it up again in the U.S.
In addition of them putting YOU into Debtor's Prison, they will also put your entire family into the same cell with you.
I guess the next thing Bush will do is bring back the thumb screws, the rack and burning hot irons being touched to your sensitive parts. |
