I owe 10-15,000 in credit card debt. I used to pay at least the minimum payment on time everytime since 2004, yet I stopped in October 2007 because I left my restaurant job and have been unemployed for months now.
Many collectors call up, but only one threatens to pursue judgment and sue me. He wants me to call him up and try and work out a settlement... but I have no job, no money right now, so is it futile to do so?
What are my options?? |

They have every right to file a judgment for the bad debt. Even if you dont have a job now, they can put a lien on anything you might own, like your house. They can also garnish your wages one day when you do get another job.
My advice would be to focus on getting a job and working out arrangements with them before it goes too far and you end up owing court costs and lawyer fees.
Or
File bankruptcy. But do your homework. Often times people file thinking it makes their debts disappear. Check into the different chapters and understand how they work. Then contact a bankruptcy lawyer. |

Don't use bankruptcy to get out of this. If you have no way to pay, they won't actually sue. They will continue to call but will eventually write off the debt. |

Find a job it you don't already have one, and make arrangements to pay. They can't do anything to you if you don't have a job. So, it would behove them if they want the money to work out a payment plan. I they do, try to get them to settle your debt, put it in writing, and ask them to have it shown on your credit report as paid in full. See if they will do this. Since this is a new debt, and you can't or shouldn't wait it out, that is how I think you should settle this matter. Just make arrangements to pay them off. If this one collector keeps calling you and threatening you, you have several options, 1: send a letter telling him not to call harassing you anymore, that he has violated the law. Get a caller ID, and don't answer any calls that you don't know the number. 2: After you figure out how much money you can pay on bills, then map out a way to pay them, and call them back to make arrangements. 3: Figure out if you are going to pay or not, and then when he/collector that is threatening you calls you ask him his name and number and were he is located, in case you may want to bring him the money, and then hang up. If he calls back, just hang up on him again. Send him a letter, stating that you would love to cooperate but you fill your rights are being violated, and you are checking with the Att.General in your state. |

telling you they are going to sue you is a scare tactic that bill collectors do to get you into paying your bills. There are several ways you can pursui this. I would suggest you go see a credit adviser . They well also give you options.
There is a letter you can send to all your bill collectors to stop them from bothering you. The letter is called a Stop ceases on demand.
You right it just like a business letter. I have put an example on here for you.
Your address goes here
Date: Do not right out date. Just put the date there.
RE: This is where you put your account# of the bill in question
Address of the company you are sending it to
Dear Burbank creditor:
SUBJECT: DEMAND TO CEASE CONTACT
Im writing to demand that you stop communications to me about my XXXXXXXXXXXXXX Account #XXXXXXX as required by the Fair debt Collections Practices Act, USC 15 Section 1692c(c).
Due to unfortunate circumstance beyond my control-------This is where you tell them why you can not pay the bill. and that you will contact them when you have the money to pay. At the end of the letter. Make it clear that you want them to stop contacting you by writing this sentence. I am requesting termination of future collection contacts. Your cooperation will be appreciated.

Your name.
This will work until they sell your account to another dept collector then you will have to write another one to them. However, I would suggest that you find a job and get these bills payed. But since your credit is most likely allready ruined. You could file bankruptcy.
Just remember there are no jails for not paying your bills, just bad credit. |

First of you should look up the FDCPA. Just know that they can't ( by law ) threaten anything they don't plan on doing. So you have to decide if you think he is serious. If he is then let him know the cirsumstances. If he says that there is nothing he can do for you let him know that he is trying to get blood from a turnup, suing you wont do any good because you have no money. Try and find a way to make SOME SORT of payment even if its 50.00 mail it in, they won't refuse your money, and this will show good faith. Also how do you know if he wants to talk about a settlment? If he left this information on your answering machine its a huge no no, Like i said look up the FDCPA and know how you are protected, find violations and threaten to counter-sue. |

I would immediately contact the professional credit card counselors. They can help you with your situation. Please start soon. You can tell them your situation. Keep in mind, these counselors are trained professionals and work for Non-profit. I am in your situation like yours but I have started the program with NFCC. Which is a national credit counseling. You wanna start this counseling because you will receive letters from credit card attornies. I recieved one from an attorney. I'm sorry if this scares you, but you gotta NOT wait, start now. Have you considered getting a job again? There are tons of restaurant and retail jobs. It may not be what you want to do for the rest of your life, but you have to put food on the table and a roof over your head in addition to the obligations you have to your creditors. Get of the sofa and get a job. |

Call them back and tell them your situation, "if you can't pay, you can't pay". Get a job ASAP no matter what it is and handle the situation. If you show them you're somewhat serious on making some form of payment. Also do a bit of research and talk to a debt solutions place (i.e. Greenpath), make sure they don't charge, because the government set them up to be non-profit. They'll talk to your creditors and work out some type of deal. Remember ignoring the problem will just make it worse, at least let them know you've made contact, they'll make notes that they spoke with you and write down what you tell them. Documentation beats all conversation. Take care and good luck. Remember you have to do to be able to do what you want to do. |

Let them make threats. They rarely go through with them. If they wanted to sue you so bad then they would have already done so.
What you really need to worry about is finding employment. Once you find a job then you can possibly work something out with them. But for now focus your time and energy in to finding a job with some income. If they do call then explain your situation again. If they threaten then just hang up. They can't do anything until they have a judgment against you. |

Well, this is very sirius my friend, and you have NO AIDIA IN THE PROBLEMS YOU ARE GETING YOURSELF INTO.
If they sue you and you have to go to court, this is what may hapend:
1-Go to jail.
2-The judge will tell you that you have 48 hours to find a job and set a monthly payment with the creditor.
3-you have to do comunity work for free untill you pay the debt, and comunity work pays the minimum. Imagine how long it will take you to pay it off.
Please!!!!!, call all your creditos and tell them in the situation you are on, tell them that you are looking for a job and plea them to have more time to find it. this way you will avoid what i just toll you. |

Banks stole TRILLIONS of dollars from taxpayers. Then they had the nerve to demand even MORE. If they can get away with criminal fraud of that magnitude, you can get away with not paying your debts.
So, the answer is: don't pay.
Get a job selling marijuana or cocaine. That at least is an honorable profession. Far more than serving meat, which is murder, to selfish customers in a restaurant.
I've got NO respect for ANYone who eats meat (anyone who is not vegan) who pontificates morality against poor people taking back from banks what the banks stole from them. |
