Credit Card Debt Help!!!?
Here's the story.. I had 5 credit cards that I have been paying off.There was one big one for 7000.00. I tried to work out a payment plan and the collection agency would not work with me. Now I got a call from a lawery's office and they are going to take action against me. The person I talked to said payoff would be 5,000.00. There is no way I can do this. I want to pay off this debt but I don't know how. I can't come up with that much money. Would it be better to just let them take me to court? I don't have any assessts either. Here is the skinny. There is no such thing as debtor prison. So going to jail is not going to happen. The worse that could happen? judgments, liens, garnishments.

You don't want them to take you to court, this would give them the power to garnish your wages (although they can't get more than 25% of your weekly pay) and would be bad for your credit report.
Try using a debt counseling agencie recommneded by the FTC. This will put a stop to them harasing you and give you some breathing time.
Here is a link to companies qualified by the FTC. There may be a small fee and in some cases they will waive the fee depending upon your income.

There are agencies that can help you deal with your creditors and credit card debt. Unfortunately the names escape me now. There is one that always advertises nationally on TV all the time.

Try looking in your yellow pages under "credit" or other similar listings.

Did you try telling them what you could offer at the moment. (cna you come up with any large sum like maybe 1000 just to start then start paying monthly.) If maybe you show some good faith, they will work with you. I also heard somewhere that as long as you are paying something they cannot bring action against you. Just start sending checks for 20 a week. Maybe they will back off. Then renegotiate the amount due after you have paid some.

I would not risk going to court. You do have an asset with your paycheck. If you lose (which you will) they can garnish your wages. Also, it will go onto your credit report. I would do my best to pay them off. One option would be to borrow the money via a website like http://www.prosper.com/join/CaliforniaSun . You might be able to get a loan that has a lower interest rate then your credit card. It cost nothing to apply and if you get the loan there is only a $25 fee for the loan.

It depends on where you live. In if you lived in Texas they could do nothing. Also if it dose go to court it will be in their county and they will not expect you to show. you will not go to jail either. worst case you can pay it latter.

Ok, as far as I know, the bank will insist that you pay, but in time, about two or three months they will sell your account to a collection agency and consider your debt to them as a loss, then the collection agency will call you to try to make you pay, but they can't take anything from you nor get you into prison, all they can do is put a very bad mark on your credit report and that's not the end of the world coz you can restablish your credit by using a "second-chance" credit card, like the ones Orchard Bank has, there is a whole "high risk" market where you can get a new card and if you couldn't pay the other one, get one with a lower credit line and tke care of it as if it was a child. Problem solved
