Credit card company threatening to take money !!?
I had a credit card with halifax bank a few years back , i basically got behind with the payments and eventually stopped paying , after several letters , i rang them up and explained difficulties in paying and i agreed to pay a small monthly amount
i have been making the payments on time every month and sometimes even pay a few extra pound when i can
the other day i had several missed called from an 08 number , eventually they rang again and it was someone from halifax demanding i pay more than the amount agreed , i explained i had an agreement to pay so much a month and she replied this agreement was no longer acceptable , she was asking for over £100 there and then (i am a single mother now and currently not working), i said i could not pa this and she was very annoyed and demanding etc , asked how much i could pay and said my monthly payments had to increase or they would just take money fm my account
can they do this and do i have to pay more just cus they say so .help please

firstly NEVER TALK TO THESES PPL ON THE PHONE !! they will talk u in to alsorts...write to them and tell them u only deal with these situations by letter ...secondly ..send them a CCA request ..(a copy of you credit agreement) if they cant produce it ,,then the debt can be enforced in court ...pls come and join us at the consumer action group forums...start your own thread on there and we will help you through this...there is also template letters you can send

Right here goe, firstly they can ask for whatever amount they want, whether they get it is a totally different matter.

What you need to do is write to them and please keep records of all your letters. When you write to them you need to include an income and expediture breakdown, basically whatever income you get in a month and then list all the items you have to have within that month to live, example, rent/mortgage, electric and gas bills, council tax, water rates, telephone, insurances, haircuts, food, clothing, glasses, car tax, repairs etc. when you have listed everything you will have an amount left over, offer to pay them this amount per month and also ask them to freeze all interest and charges on your credit card account.

As for raiding your bank account the answer to this YES, and they will do this to try and clear your debt with them and they will clear your account every time money is paid in. The first thing you must do is open another account with another bank and have your money which is paid into this new account, that way they cant just grab your money. Dont forget to change your existing direct debits to your new account as well.

As for the telephone calls you are getting form the Halifax thats another easy thing to sort out, answer the next one and tell them you are writing to them and will be including a income and expenditure ad an offer of payment to clear your debt, also tell them that if they want to contact you they must do this in writing and make no further phone calls to you because if they do you will make an official complaint to the Financial Ombudsman tell them the Halifax is harrasing you and putting you in distress. THE CALLS WILL NOW STOP, if you are not confident to tell them this, change your phone number and do not give them your new one, they will have to write to you then.

I hope you sort your problem out but if you are in severe difficult debt problems there are organisations out there who will help you free of charge, Make sure that thay are not a company looking to make money out of you. I have included the website address of an organisation in the uk which is funded by the banks and credit card companies to help people affected by debt, they are a charity and will help you totally free of charge, but they are very very busy as they are a charity.

I hope you sort yourself out, don't let the Bank bully you because they will if they think they can get away with it

thats harrassment, it's illegal.

phone them ask to speak to a customer services manager. They usually record calls so you will have no problem getting them to understand the error of their ways. Citizens advice might also help you sort out a letter of complaint

Since you are not in the U.S. this answer may be wrong- but here, no they cannot take money on an unsecured loan/credit card from your bank account.

They can't take money from your account without your say-so... speak to citizen's advice bureau if they insist again.

Do not take calls from them. YOU be the one to call, that way you know for sure who you are speaking to.

Reread the credit account agreement that you signed. Many creditors include as part of the contract, a clause where you agree that all accounts with the bank serve as security for all other accounts. If Halifax did, then it's legal.

You need to take advice. If you are not currently working and claiming income support you only have to pay creditors a minimum amount (I think it's 2.50 per week). This is harrassment, next time they phone tell them so and that you are going to take advice about it. My partner had exactly the same trouble with Capital One, but as soon as he did this they accepted his offer and stopped phoning. Also if they have charged you for late/non payments in the past six years, check out www. Martin Lewis Moneysaver. He has template letters for you to claim back unfair charges. My partner got £88 back and it's really simple to do. Best of luck.
