Credit card issues with non payment - 3rd party calling me threatening with court. What's my rights?
I had a hardship about a year ago and finally get all bills back in order. My credit card is over limit by 1300.00 - the total is less than 5k. I got a call that the credit card "sold" my debt to a 3rd party. Now 3rd party is calling me and I said I could make a monthly pmt. but was recorded and said "we'll see you in court". What's my rights? Don't they have to accept mo.pmts. and see I am serious about paying it off which are my intentions. HELP!

my boyfriend was sent to collections, and what he did was write a letter to the collection agency saying he was going to settle his debt with the initial creditor. he then made monthly payments to the original credit card company and paid off his debt that way. it didn't hurt his credit as bad as settling with the collections agency would have.

No they don't have to take payments if you are in default. You are definitely in default. They can legally demand payment in full. Scrap together enough to offer them a settlement in full. Depending on how old the debt is. They will probabley settle for 50 or 60 percent of the total.

If you come to a settlement agreement. Get it in writing and do not give them Electronic access to your checking account. Send them a cashiers check.

The guy who said that credit card companies could not take you to court is WRONG! They can and will take you to court and when you get there is it going to be kangaroo court.
If you are in Indiana and the credit card company is capital one...there is 100% certainty that you will go to court. There is 200% certainty that if you do go to court you will get your wages garnished and that attorney's fees and court cost will be added to your bill.

People mistakenly think that creditors have to accept small payments because they are made in "good faith". But that is absolutely not true. When you failed to make payments as indicated in the agreement you signed, you defaulted on the contract. This means the whole amount is now due.

They don't have to offer or accept any payment arrangement. In fact, even if you send them a payment, they can take that payment and sue you anyway.

More credit card companies and collection agencies are going to court for smaller amounts. Your credit is already damaged by the default and the account in collections. When you lose in court, and you will lose, your credit will be further damaged by a judgment which will stay on your report for 10 years.

Send the collection agency a certified, return receipt letter requesting validation of the debt to include the date and who they purchased the debt from, the amount due, and an accounting of the charges and fees.

When you receive validation, you can start to negotiate a settlement. If this debt is less than 2 years in default, you will probably have to offer at least 75%. Lump sum gets the best deals. Payment plans have to be short term. Get any settlement agreement in writing (don't talk to collection agencies on the phone) and don't give them direct access to your bank account.

They can take you to court and they do not have to take payments. Look at the amount you are over your limit. There is a good chance your wages will be garnished. I'd try to get the whole amount asap.

They should accept any reasonable offer you make, you should contact citizens advice (If you are in uk) or another legal equvilant if in other country and get them to write to the company stating what you can afford to pay each month. If they still insist on taking you to court then i'm almost sure any judge would accept a monthly payment. They cant make you pay the whole amounth if you do not have it.

I'd be a bit suspicious of someone who just phoned up and told me that they wanted money from me. Get them to send you an accounting of what you owe and make sure that they are a legitimate debt collector. As for their threat to sue.... its a common threat. The court won't give them any more than what you owe and will probably agree to payments so they'd gain nothing by it.

okay CREDIT CARD COMPANIES CANNOT TAKE YOU TO COURT. this is a tatic that many bill collectors you so you will pay up. a third party collection agency means that the credit account that is deliquent will no longer be with the credit card company ( there are specific department that within the credit card call center that deals specifically will past due account) no worries okay. the worse that they can do to you is hurt your credit score. bill collectors are some of the worst ppl
