Credit card of deceased person?
My mom passed away and left a credit card debt. They have a house which soon they will default on. No equity there with today's market. No savings and insurance. We are in CA. She's the only name on the card but I'm not sure if they can go after my dad, them being in CA.

A marital debt is a JOINT debt. It doesn't matter whose name is on the card, or the loan, or the car loan, or whatever debt is owed. Your dad is legally liable for that debt. Credit card companies are not in the habit of forgetting a debt just because a person is dead. If there was no spouse, the estate of your mother would be held liable. the estate being whoever is responsible for paying the bills, dispersing property, and what-not.

*Note to Frissy* That is not true that only joint debt is joint debt....ANY debt assumed by EITHER partner after marriege is JOINT debt. If my husband were to buy a car and keep it in his name, do you think that after he died, I wouldn't be held responsible for that debt? It's community property, and it's community DEBT. Same with any loans, real estate etc. ESP. if we shared everything else, like a tax return and checking/savings account. It's not the laws job to decipher what is his mine and ours. If we divorced, I'd be entitled to legally take half of our community property because it's legally mine, but you don't think the same is said for debt? Guess again.

It's likely they'll go after your dad if they shared other accounts, i.e. bank account.

One thing to remember is that most creditors will make a claim against the estate of the decedent for any monies owed rather than approach a relative of the deceased.

I agree w/ "Cara", but yet living in Louisiana, I've heard diffferent stories about such things.... The debt may then go to the heirs....

I'm not positive about this but I believe when a person dies, the credit card debt gets wiped clean. Let the company know that she is deceased and obviously will not be paying the bill. You can always call them and ask.

Only joint debt is joint debt. If your father did not sign up for the credit card, HE is not responsible for the debt. HOWEVER, if your mother owned the house joint, her share of the equity in the home stands good for her debts. So if your father doesn't want to lose the home (or sell to cash out her share of equity) he will have to pay the debt.

He needs to speak to an attorney and a CPA.
