shells11 | Credit collection? |
I have a collecting from Palisades Collection LLC that is on my credit report. My current score if 650, not good, but not horrible. I am trying to raise my score. the collection is from Alltel for 300.00. i have had the collection on my report showing for 3 years. i don't really have the money to pay all that and honestly shouldn't be owing Alltel anything in the first place. my contract was up when i switched to another cell company, but they charged me a termination fee anyways. I don't want to put myself in the hole paying this and i don't want my credit to continue to be affected. What can i do to raise my credit score and get this off my credit report? |

Ah yes, another classic collection agency that is well known for trying to collect debts that are unverifiable
You can read more about them at this link
http://www.budhibbs.com/debtcollectorpages/palisades_collections.htm
Check your states statute of limitation on collection of this debt at the following link.
http://www.bcsalliance.com/statute_of_limitations_on_debt.html
If Altell has sold this debt off, then it may be beyond your states SOL to seek legal action. So along comes Pallisades to try and scare you into paying it.
You can send a request to the CRA reporting this on your report and dispute the debt. They will then have 30 days to contact Pallisades and get validation of the debt, if Pallisades has no proof that they legally own the debt or proof of the debt, then the CRA will remove it from your credit report.
DON'T DO THIS ONLINE, this will only get you nowhere,.here is a link to explain exactly how to dispute with the CRA's. It is the rules they play by.

You can dispute it and they have to take it off by law.
But if its a rightful debt the only way to permanently remove it is to settle the obligation with Alltel. |

Truthfully you should have fought Alltel on this years ago when it happened, but since that is not an option if you still have your contract and can prove you didn't cancel it early they will have t remove the debt.... other than that you would have to pay it off if it is legitimate but the bad account will still be on your account for a few years. |

I wouldn't recommend paying the collection off anyway. If you pay an item that old off, it "redates the item" and often it Lowers your score! Pull your credit for all 3 bureaus thru http://www.annualcreditreport.com. You are entitled to 1 free report a year (you have to pay a small amount for your scores). Then go to the 3 bureaus sites and get their address for disputing items. Send each a letter explaining exactly why this collection is an error and ask each to Remove (Not fix or correct) the item from your credit. The creditor has 30 days to prove it to be accurate or it will be removed. Even if it were correct, they probably wouldn't bother due to the age of the collection. Reference their cr. report numbers in each of your 3 letters and send the letters with a copy of the page with the item circled on it. Send them Certified mail. I know that will set you back over $5 each but you must show them you are serious.
Good Luck

You have to pay it if it really is yours but they probly will settle but only go with a settlement if they agree to delete. A 650 is a good score so you may be better off just letting it go, but try first to dispute it with the credit bureau, but dont contact the creditor unless you decide to pay because if they are not sending any letters now or calling then if you call them it may stir it back up again and all the harrassing phone calls and letters may start back again. |

pay it or you should have disputed it before it went into collections. Collection agencys don't look into that kind of stuff for disputes unless you have vaild proof. |

Whoo-hoo, this is still fixable. Be quick, diligent and patient...it can be done!
1. Order your credit reports from the 3 bureaus
www.equifax.com
www.experian.com
www.transunion.com
If you're ordering for the first time, get your score (for a fee) from Equifax as their scoring matters most.
2. Make copies of your report and put the originals in a binder. On the photocopied reports use a highlighter and check for any incorrect, outdate, false, etc...info
3. Download a dispute letter(s) from the credit bureaus website and list anything that is wrong. Mail them to their office(s). They have 30 days to reply.
4. If they will not remove something that is not yours or too old (> 7 years) as them for a debt validation. This may take an additional 30 days.
5. Once the 'baddies' come off, take care not to let any of your other accounts fall into that predicament.
6. If you haven't already make sure your existing accounts are current and paid on time ALWAYS.
7. Get a secured credit card with www.capitalone.com or www.mastercard.com for like $500-1000 or more if you can and use it sparingly. Charge like $50 on the card each month and pay it in FULL and on TIME. Make sure you do this for a minimum of 6 months so that you estabish a positive repayment history.
8. Problem with just letting them (collections) 'fall off' is that they may never. You may get sued before that...that's where you suddenly get a summons to appear in court and a judgment for collection against you.
For collection items...pay them but get a 'pay for delete' from the collection agency in WRITING...they'll delete it after you pay and it will help your credit score. |
