All banks do it!!!

The principle behind it is that if you go overdrawn (or over your overdraft limit), your breaking your accounts terms and conditions, so they slap a penalty charge on you of £20 - £30 usually.

However, under the Unfair Terms in Consumer Contracts Regulation (1999), a penalty charge should be no more than the cost to the bank because of the breach, no business is allowed to make a profit from the charge.

When you go over your overdraft limit, or bounce a cheque for example, the letter and penalty charge are created automatically by the banks computers, costing them no more than £4.50 (probably a lot less!). Because they charge you £20 - £30, they are making a profit from it, which is illegal.

This is why people can claim back their bank charges. The banks are not defending themselves, as they don't want to admit the true cost of the breach in court (as the banks don't want their competitors knowing the true costs of the banks business practices), and also because if they reveal it in court, it means that everyone could claim bank their charges and the process would be easier. Its better for the banks if hundreds of thousands claim back their charges, than everyone in the country claiming back their charges.

They all do it. Any bank that charges you more than £5 for bouncing a direct debit etc is overcharging you and you can claim it back. Their charges have to reflect the cost and not be punitive. Anything over about £5 is punitive.

Most banks overcharge their customers how else would banks make so much money. Most of their services are intangible and the cost not easily assessed by the public.

You will find that it is a banks silent policy to overcharge their customers. We all accept a charge that is justified but banks are not considerate of our individual circumstances, or even our feelings overall. They are functioning on a desire to profit.

When a bank offers a loan or an overdraft or even a higher limit on their own credit cards, do you think they are really trying to help you? Of course not because at the end of the day they are going to profit from your repayments or the interest on any used overdraft.

Always be cautious and know your rights when dealing with banks. And if you can, keep a good reign of control over your finances so that you have no opportunity to line their already full pockets.

It does seem that the majority of banks overcharge. May I suggest you visit the LBC website www.lbc.co.uk follow the Nick Ferrari page and there is a letter that people can use to claim back charges that have been made. Just fill in the details and delete irelevant sections and send it to the bank. This worked, with Barclays, for my daughter-in-law.

I think all banks do the best bank at the moment is the Alliance and Leicester. Have a look at www.moneysavingexpert.com very good advice.
