No. Illinois is not a community property state. The only liability would be to the estate.

In theory, your husband's estate is liable for his debts. In practice, most people die without enough assets to have an estate.

If there's an estate, then the credit card company and any other debtor would have to be notified of your husband's death as part of a process called probate. Probate is a legal process for making sure a will is valid and distributing the deceased person's assets to creditors and heirs. Through probate, the deceased persons debts are paid off and anything left is passed on to the heirs.

For most people, though, there is no probate, because the assets they leave behind are exempt from the estate process. For example, the primary residence, if in both names in Illinois, any life insurance that has you as the direct beneficiary, these things usually pass free and clear to the surviving spouse and can't be claimed by some credit card company.

So if your husband had a lot of assets, your best bet is to get a good attorney. Either way, you should let the credit card company know he's dead. In the meantime, don't make any payments to them and don't use cards that were in his name.

It is important that you send a copy of the death certificate to the creditor as soon as possible. In your letter explain that this card was the spouses responsibility and that you did not agree 'by signature' to be responsible for the spouses account.

Make certain that you send this letter certified mail return receipt requested.

Make sure you keep a file of all communications.

Sorry to hear about her death but unfortunityly when you marry you are as ONE so yes! For instance if you had kids but didnt want to pay the child support or didnt have a job or EVEN if you died with out paying the child support, it would be left to your wife to pay. This has happend in East St. Louis....You might be able to get some assistance but the IRS will come after you eventually

Don't know if its based on state or federal statutes but if the credit card was obtained during the marriage, the spouse may be held liable. If it was an old card, obtained before the marriage, the spouse is off the hook.

It doesn't matter if its on their name only. Like they say when you get married "their money is your money" likewise "their debt is your debt". Unless the debt was incurred before marriage!

Nope, not directly anyway. The credit card company may make a claim against the estate if the will is probated. But a person whose name is not on the account cannot be held responsible for the debt, regardless of their relationship to the deceased debtor.
