Does credit card debt get written off when you die??
My sister-in-law died yesterday as she had cancer but we expected her to live longer. I have just heard that she has spent around £20,000 on credit cards since been diagonised with cancer in September. She has no money or assests but the house is in joint names with her husband. Will the credit card companies write off the debt or chase the husband to pay it??? This is in the UK not USA as their laws maye different.

My gut feeling is that the husband is not liable as the spouse, but the credit card company may try to get their repayment from her share of the house. In practice, the widower may not wish to sell the house, and would have to pay debtors off to be able to keep it. I think he should take legal advice on this one.

No it gets passed on to your executor.

Any debts you owe at your death will be paid to creditors from your estate.

If you have no estate they may try and sell your body parts!

I bet they will try to recover through the husband,was the credit card account in joint names?.,if so,he's screwed big time,check it out with the CAB,they normally have all the answers

If the owners of the debt act fast enough it will be a debit toward the Estate

The creditors can try to get the money from her half share of the house. If the card is in joint name, her husband will be responsible to pay off the debt. Whatever it takes, the credit companies always get their money or they will at least try.

Hi....Im sorry to hear of your loss.


the debts die with the debtor....but the credit card company may attempt to claim off your sister in laws estate....if they did they would be too embarrassed to let it go as far as a court

Your brother? will be sent a questionaire asking for details of what cash was left in banks...did she leave a car...a soley owned property etc etc.....just tell him to tick No on all the boxes and provide a copy of the death certificate. that is usually enough for them to back down

I am not in America, but usually here in Britain, the debt is covered by life insurance provided by the bank.
