Car is in both names (registration) but insured in my name. I have been the sole driver of the car since purchasing it. I have made ALL payments. Ex does not want his name associated with loan. His responsibility to have his name taken off? I work bankers hrs and the bank is out of town....he works 2nd shift and can do it. It should be his responsibility, but just for heads up, I would go to the bank myself, or call them and have them send the needed paperwork to you and take it to him to get it signed and make sure the bank gets it.... have you seen Court TV? It may come back to haunt you later..... get it done.
Don't depend on him to do it.... |

Its his responsibility..BUT....if you do not have pink slips on it yet...and you do not have enough credit to take on the car in your own name..WHICH you didn't at the start of the loan. The bank who gave you the loan now has the ability to come get the car from you. |

To have his name removed from the existing loan, you will need to refinance the balance in your name only.
As far as who is responsible? He should be, but he can not be since you are the only one who can finance in your name only. So if there are any fees or additional interest that you are stuck with, they should be his responsibility to pay you for them up front. |

You can call the lender to see if they will release him, but it is likely that neither of you can get his name off of the loan without you re-financing the car. The lender required a co-signer for a reason, likely because you had a low credit score. Unless your credit score has improved significantly since you purchased the car, the lender will still want both of you to be financially responsible.
If you can't refinance the car on your own, and the lender won't release him, he is stuck with his name on the loan until it is paid off. That is the hazard of co-signing, and he should have recognized that before he signed his name to your loan. |

in my experience, you are both going to need to stay on the loan untill it is paid off.... an easy way to do this early however, is by refinancing the car loan, with just you as the borrower...

Since you were the first signer & he is the co-signer, it is your responsibility to remove his name. You will most likely have to refinance the car to get it in your name only.
I did this 3 yrs ago for my Jeep and that's how my bank made me do it. Just be sure to have all the paperwork associated with the car on hand. You will also need to change the registration/title to your name too. |

both of you have to agree to remove him from the loan. have you tried contacting the bank, they should be more than willing to help you with this. you need to call the customer service line. most finance companies are not in the state of the purchaser. dont wait too late or this can get nasty. |

Chances are, in order to get him out of the loan, you may need to refincance the car so that it pays off the note and leaves you the note free and clear. Plus, it may also give you a better chance to get a lower interest rate and monthly payment.
It's a hairy situation when you mix credit before, during, and after you've been married. My suggestion would be to refinance like I had mentioned earlier because obviously your schedules aren't cohesive enough to try to get it done any other way. |
