I reported a lady(an overstayer) who used fake documents to open a current account with a high street bank.Upon investigation,if it is found that the bank granted a loan to her,ie,she owes the bank,what will happen?

The documents are fake,with a fake name that can't be found on any data base.She managed to open the accounts with the help of a bank staff who knew that her documents were fake. |

The bank will probably cover its tracks to hide the huge mistake they made. May ultimately write off the amount owed as a business loss. |

Good for you, I remember the dilemma. That bank will investigate it and that employee may be liable or not depending on the papers that were used. But the woman may be charged! |

Technically she should be reported to the police for fraud, but the banks have their own internal investigations departments.They may decide that the amount owed to them may not be big enough and they may not take it any further.
If she is an over-stayer there is a likleyhood that she would be bailed back to her home address pending an imigration investigation. Of course this would mean she will just go underground again and avoid detection like the 10`s of thousands that already get away with it in this country. |

I would say that she is going to see a jail sentence out of this one for committing fraud. Heck, when people bounce too many checks they go to jail. Usually when documents are signed they have an area that says that the information I gave is true to the best of my knowledge. I am a criminal justice student and just got done studying about this. |

Depends who you reported to and what she is doing ...
The local bank will simply want their money back = if it is secured against property / car etc. they won't worry too much so long as she is making payments = they have no interest in taking any other action (such as reporting to Police / Home Office etc) since all that does is complicate the loan ..HOWEVER they have a duty to comply with the law so will (eventually) get around to investigating the fake documents and, if confirmed, will contact her asking for their money back and report her to 'the relevant authorities' (who knows how long that will take)
You local Police will simply pass the report on to the 'relevant authorities' and (so long as she is not involved in any criminal activity - for example, Benefit Fraud, Drug Dealing) again will have little interest in taking matters further.
You local MP might take up the case - however he/she perhaps more likely to try to get the overstayer granted an extension to their Visa = they do not want bad publicity eg. 'MP hounds refugee', 'MP sends refugee to their death' etc.
So, unless she becomes involved in actual criminal activity, I would suggest very little will happen in the short term ...and by the time the 'relevant authorities' send some-one to find her, she will be long gone .. |
