Garnishment of wages?
with a garnishment against your wages can they take money from a checking account in your name?

Only the government can put a lien on your bank accounts. So, if your garnishment is from a state or federal taxing agency, then yes. If your garnishment is from ANY other source, then no.

Good luck.

If there is a judgment against you, they can garnish your wages unless you live in Texas or Florida. They can also put liens on your bank accounts and other assets. That includes your checking account.

girlb00
no - only from your paychecks before they get deposited. they work with your employer to do the with-holding

missemotion75
yep,it almost happened to me but i fought back!!! they were not able to do that before, but they can now.find an attorney that gives free consultations so he can let you know whats up and what you can do before those jerks take your hard earned cash!

JEN â„¢
no they garnish ur paycheck. not ur bank account

northboy
No. They can't.

No. The money will be taken through your employer before it ever gets to your checking.

DaMan
No, they get in the best line possible ==> they get all up in your paycheck like the IRS, FICA, State Tax, and Medicare payroll tax deductions.

Now you know.

happydawg
No. The garnishment is signed by a judge and a copy is sent to your employer who gives you your paycheck. The garnishment is taken out of your payroll like taxes and all the other stuff. They do not take money out of your bank.

Mother Bear
The government can, but they are the only ones. The government does it before they garnish, so you don't have to worry if you are being garnished about losing your cash on hand.

Not usually. But the Government can attach assets.
Some States don't allow garnishment. Others have a cap like 25%.

no idea?????

no they cannot touch these accounts . are your sure that a order of garnishment has been ordered . collection agencies are the most disbicable people imaginable . will lie , violate the law , make threats against wages . when the favour is returned to them they phone the police . court order is not that easy to get v. i think you or someone you know has been harresed by collection agency . ignore them .

msdarkness
probably not but they can and will freeze your account.

stan lee
No. They do not take anything from you by them selves. They contact your employer by means of a legal nature, where they must comply, & the court orders them to take so much of a percentage from your check to be sent to them each payday. So, your employer is the one who is actually paying the garnishment for you out of your own money!

No. A garnishment of your wages means that your employer is ordered by the court to withhold money from your paycheck and turn it over to the trustee, who will forward it to whoever you owe money to.

They can't go into your checking account and take money out unless you give them written consent to do so.

depends on your state laws. Hope not.
