Getting back credit card charges?
My credit card just defaulted, and they company are being pretty awful to me. I am a student and genuinely cannot afford to pay the large sums of money that they are expecting me to pay back.
I have been requesting for a long time that they send me statements as they have been sending them to my old address for the past 4 monthes. This they have not done.
I heard that you an claim back credit card charge's, does anybody know if this is true or how i do this?
Also is this company allowed to demand that i pay back approx £50 a week, when tht is more than my weekly income?
And if they take me to court what will happen there?

go to C,A,B they will send them a letter, credit card company's are not allowed to give cards to unemployed or students on low incomes as they can not pay the money back, the banks do not tell you that you will be paying an extortionate amount of interest back on the money you borrow otherwise they know you will run a mile, when it gets sorted out cut the card up, close the account and learn from this first time to never get a credit card again. This country is built on debt and it wont stop until these banks lose money after cards given to those on low incomes

If they take the case to court, the judge will apply an order in relation to your income and outgoings. Regarding being reimbursed for charges I think you would find it difficult unless you have grounds to apply for charges illegally made by the credit card company. If you are in any doubt, contact the Financial Ombudsman.

Ignoring shortbreadtin's and slippery magoo's "soapbox" answers (like you've never made an error?), pinhead is right. CAB can be pretty good in these situations. They can help you to negotiate with the card company and sometimes freeze (or even reduce) interst charges.

try to avoid the court option as you will be lumbered with a ccj and court costs.

Defaulted means you have stopped paying your credit card bill. This is a serious situation. You should seek professional advice immediately. I would contact the Citizen's Advice Bureau. http://www.adviceguide.org.uk/index/life/debt/help_with_debt.htm

They will help you reach an agreement with the credit card company to pay back what you owe by paying an amount you can afford. If you do this you will not have to go to court.

You can only claim back charges if you can prove they are unfair. You cannot claim them back if they are because you haven't paid your bill.

1. Log onto your account via their web site to change you address.
2. Call them to negotiate new terms if possible. You will have to pay them back in one way or another.
3. If the future, don't spend more than you can afford to pay back in full on a monthly basis.

you can claim unfair charges back from credit cards and bank accounts - ie, defualted payments, unauthorised over draft fees etc!
There are companies out there that can do it for you, but it is just as easy to do it yourself - you will need copies of all your statements for the up to the last 6 years - this will obviously be less if you have not had the card/account that long. You can also claim the interest the companie would have earnt off that money too!
I have included two links below - one will help you do it yourself, the other is a company that will do it for you, on a no win no fee basis - but will take 25% of whatever you reclaim - once the company has refunded the money!

There is a great site, not for profit, called moneysavingexpert.com, and they have a guide showing you how to reclaim unfair credit card charges (plus bank charges in a separate section). Only reasonable charges can be claimed, and they are often very unreasonable!

As others have said, CAB have experts that will negotiate with lenders for you, in order to seek an affordable payment plan. Their service is free. I wouldn't use a co. to reclaim your fees, as they will invariably take a cut of the cash.
