I had a loan with a credit union and paid it off (so I thought) back in Nov. 1007. The balance was around $14,000.00. Seems there was still a balance of $979.00 left. The loan was taken out in CA and I now live in NC. I have moved a couple times,had a couple different addresses,so my mail was messed up for a while. Since I paid it off,I haven't received any correspondence. I just went into my credit monitoring and there is a suit/judgement for $979.00!!! What do I do......I can't believe this! I never had any indication that there was still any balance and no phone calls....nothing! HELP Please! Additional Details I did a debt consolidation so I was paying off a bunch of stuff,then moved,changed addresses,email,phone,etc...just didn't think about contacting them cause I thought the thing was paid off! If I pay it,will the judgement be removed,or do I have to do it by contacting the credit bureaus? |

The Credit Union is only obligated to put forth a limited amount of effort in locating you and if your mail was not forwarded each time you moved, you may not have gotten the court order. But, because it was sent and you didn't show up for court, the Credit Union got what they requested from the court, therefore you have a judgment. You can try to talk to the Credit Union about this and see if they would be willing to settle the matter. Explain what happened and see where it gets you. It will take the creditor to get this removed from your credit report. Otherwise, you have this horrible blemish on your credit for 10 years. (most debt leaves the report after 7, but judgments last 10) |

Did you get any sort of notification from the creditor that stated that the debt was paid in full? If so, you need to call the creditor listed on your credit report and give them that information. If not, you still need to call the creditor and try and work something out with them. If you explain the circumstances (and have some sort of documentation to prove that you thought you paid the debt), they might be inclined to work with you. |

Call the loan company and find what the 979.00 is for and where did they send the late notice to. If you in fact owe the money make arrangement to pay what was actual owe I bet there penalties on and interest on the amount. When a judgment is issued it is next to in possible to get it remove without paying it. They are renewable they stay on record for 10 or 20 years and when that time is up that have it reissued without even going to court |

Contact the people you owe money to and arrange to pay it off. People make mistakes. This one is easily fixable. |

You should have kept better track of your payments. Call the credit union or whatever collections agency has purchased the debt and ask if you can pay off the balance and have the problem taken care of, but the judgment is binding. |

If you have the contract and it shows that the loan has been paid in full, then just send a copy to the CRA that is showing the derogatory entry. They will have 30 days to verify this with the credit union. If it is indeed an error the CRA will remove it and send you a corrected copy of your credit report.
If the judgment is a legal one, your only recourse is to find out in which court the judgment was awarded and file a motion to dismiss for "improper service" and request a Reverse Judgment, which means you were never legaly served a court summons. No doubt they won by default due to your not answering the summons and failure to appear.
Reverse Judgments is a term that means to "overrule" a lower court's decision. When debt collectors win a default judgment, it's possible to have it overturned, overruled, set aside and vacated. This terms simply mean the default judgment is removed and is no longer binding.
In order to have a default judgment overturned, you'll need to prove that the judgment was granted without you being given due process. This generally means you were not able to appear in court for various reasons and therefore, not able to properly defend yourself. Obtain a copy of ALL court documents concerning the default judgment and look them over for any mistakes. Pay close attention to address, notification procedures, dates and names.
If you can prove that you were not properly notified or that some emergency prevented you from appearing in court, request a rehearing also called a motion to vacate judgment

Contact the people you had the loan with and check if you still owe them money. It could me a mistake and they can easily remove the default/judgement from your file within about a week.
If you do still owe that amount pay it off asap so the debt is removed. Then write a letter to the credit reference agency asking them to put a note against your credit file saying the debt has been paid and that the original loan was repaid minus 979.00. Say that you thought you had paid the loan in full, were never chased for the 979.00 and it was a shock to you to see you still owed the amount which you made arrangements to pay immediately as soon as you found out about it. |

Unless you received a notice of satisfaction (or similar documentation) you probably paid in the prinicpal full but didn't pay the accrued interest.
Just contact them to pay it off immediately so that it will fade from your record sooner, rather than later. |

Mostimes collection agencies tack on a hefty fee of at least 50%. That means that that bill could just be for $450 or much less.
Call your bank. Find out the balance and pay it. If its too late settle with the collection, but never for more than half.
Also, I had a collection similar. I never paid it. I called from a cell phone, so they never got my number. Since it was so close to the 7 year expiration period, I let it go.
A year later, I asked the credit agencies to take it off the report, and they did.
They have 7 years to collect. If they don't -- too bad for them. |
