Harassing phone calls- Do I have any recourse?
My husband and I moved to a new state 4 months ago. Since our phone number was activated, we have received an increasing number of phone calls from debtors and collections agencies asking for two people that we do not know and do not even have similar names to us. The calls have started around 1 per week and have increased to as many as 3 per day. I have talked to many of these collection agencies and kindly informed them that K and Mrs. C do not live there. I have adjusted our outgoing message informing them that they do not live there. However, the calls keep increasing.
I'm guessing they don't believe that I'm not these two people.
What else can I do? (Other than changing my phone number, which I'd prefer not to do) Do I have any legal recourse if they don't stop (keeping in mind I can't afford a lawyer)? I don't care about suing for money, I just want the calls to stop.

Our phone number is unlisted.
We'd had hoped to avoid changing our number since we just gave it to all of our family, friends, our (good) creditors, and professional contacts.

I used to be a collector and I can tell you the phone calls will not stop unless you take the proper actions. It doesnt matter how many times you tell them, it is part of theri job to call any and all numbers they have on file, weather or not you tell them it is correct or not. (a) start loggin the times they call you and the names of the collectors you speak with. (b) find out the names of the companies that are calling you. If this means you have to lie to them and tell them you are or know the people they are looking for, this is a very important step. They will not tell you their company until you confirm you are who they are looking for. (c) when you have logged about a week worth of calls and names of people who called, ask a collector for their corportate address or look it up online. Write a letter demading they stop calling and include a copy of your log. This will be legal recourse for THEM. They are requiered by law to stop calling as soon as they have something in writing. Give your letter about a week or so to take effect and the calls will stop.

Next call, tell them that you are considering legal action. You don't have to actually do it. In addition, a letter from an attorney is relatively inexpensive and some attorneys probably have form letters ready to send - this sort of thing isn't all that uncommon. If that does not work, get the phone company to block calls.

One thing I have seen. It's cheap. Get a whistle and leave it near the phone. Blow very hard on it near the mouthpiece when you receive such a call. That will make them think twice about calling again.

You may be able to ring your phone company and alert them to what is happening. If you have caller ID don't pick up the phone. Other than that keep a log of the calls and numbers and report them to the phone company. They then will send out a letter to the company asking them to cease. Hope this helps and good luck.

Sure, under the Fair Debt Collection Act, you can send a "Cease Communications" letter to a debt collector. Per this federal law they must stop calling. Send via Registered Mail with Return Receipt.....Be careful...if we are talking about a fairly large amount of debt that is recent and within the statue of limitations for your state....sending a Cease Communications letter might provoke more aggressive actions like attempting a judgment against you.

sorry, i went thru that too, without a lawyer, your pretty much screwed. however i was able to change my number for free. you could start answering these calls "doe residence you are on a recorded line, hello".... might scare them off, and pretend to write down thier name and tell them that is thier last warning ... that you will pursue legal counsil if they call again.

hi sorry to here that any way first you need to get caller id on your phone, so you can recognize the caller if you know the number ans if not let it go to voice mail also on your voice mail say something like you have reached the jon doe resident please leave a mess.... inform your friends and family so they know that if they are calling from a new number that you don't they should leave a message because you wont be answering any unknown number. [ it worked for me may work for you good luck]

You have the right to call block and report the calls to the phone company. Bellsouth/AT&T has *57 for reporting harassing phone calls, or you can go to this website for more assistance:

Yep, you obviously got issued their old phone number. Hate to say it, but changing your number might be the best way to put a cease to it. I'd raise hell with the phone company and ask them to change it at no cost to you.

They are not going to stop calling. Only other option is to get caller id and don't answer the phone. They you will just have to delete their nasty messages.

Best to change your number.

No legal recourse. Just get the number changed. Why suffer. No you don't need to hold on to that number, get anunlisted.
