A women from the bank of america credit card collections agency keeps calling my phone calling me Amy and saying that my account is in collections and I need to pay if off! Well for one I've never had an account with bank of america and my name isn't amy! I tried to tell her this and she just kept going on and on about this persons credit cards! She was giving me all her information and account number as well! When I missed the call today and called back some guy asked me for my social security number so he could verify I wasn't Amy!!! What should I do and can they do this?! |

you have a few things to do,
1) best choice call bank of America talk to someone in management over these calls demanding them to stop they should have your phone number on file. I would also talk to a management about the ssn# they should not be asking for that information. And if there is another call that your are going to start legal proceedings for harassment.
2) change your phone #

Well she's breaking all the rules by giving you information. They can verify info, but they are not supposed to actually give it to you.
You should get Bank's of America's corporate number, and call them and tell them what has been going on. |

If they're asking for your SSN... and supposedly giving out someone else's information... it's quite possible that they ARE NOT Bank of America, but scammers looking to confuse/hassle you into giving up information they can use. DO NOT GIVE IT TO THEM.
If you think that it might indeed be Bank of America, then they are breaking the law by disclosing third-party information (why I'm very suspicious that this is a scam). It also seems very odd that they'd ask for your SSN. You could look up the number to BoA on their official website and call directly (that way you know it's the real company) to see if they can find any information on this, or report fradulent use of their name. |

Harassment is the right word for it. I just had to tell Cable Vision today that I did not want them to call me anymore. They have been consistently calling me to ask me if I would like to get phone service with them and every time I indulge them and actually listen to what they have to say and then I let them know that I don't want the service. But I started getting fed up with them when they started calling everyday just to ask me if I wanted their service. NO. NO. NO. NO. NO. A representative called today and asked me the same question and I immediately jumped in and said at this point, the company is harassing me and I do not want the service from them, so stop calling. It should have already been noted by them that I did not want their phone service. Now to really answer your question, I think that you should try to block the number or call the company and file a complaint with the bank and also call back the collections agency that is harassing you about this woman's account. Let each of them know that you are not the woman they keep calling about and they need to stop calling you and that they should not have been giving out her private information to you once you told the agent that you are not this woman. And you should also maybe write a letter to the collections agency, letting them know that they have been harassing you with phone calls that should be rightfully going to another woman. The next time they call, ask for the name of the collections agency and then look it up and do some research to see if it is legitimate. |

Next time they call and give you this "Amy's" info write it down and call Bank of America and give them all the info that this person has been giving you, and don't call a # this girl tells you to, look it up yourself so you know it's legit.And never (especially because this has nothing to do with you) give out your social insurance # or anything like that, that's how identities get stolen. |

Do NOT give your ss# over the phone to anyone who asks you for verification! Never ever ever ever...they will always ask for some other identification other than your ss#...bc it is not you or your bill it will not affect your credit. Tell them to stop calling you, and tell them that they have to stop. There is a way to actually get this done officially...i'll look it up and edit. |

Never, give out your social security information, ever. Next, tell them you would like to be removed from there calling list immediately on the grounds you are not her. Write down the time of the call, the operator (name of person, ID or extension number) ask or take off caller ID there number, and ask where there call center is located. Tell them if they call you again you will sue for harassment. If they contact you by mail. Send a "cease and assist letter" stating you are contesting the validity of the debt and they are not to contact you or again you will sue. Also, remind them that in addition to suing you will be filing a report with the Federal Trade Commission for unlawful debt collection practices to which the Federal Trade Commission will be investigating your claims and possibly giving them lots of fines. This always works. |

Contact your local Better Business Burea and ask them. Each state varies...it could be they have a limit and they could tell you. Whatever you do, do not give out your ss# over the phone. You wouldn't want to have you id messed with. |

The agency I work for collects for BOA among other companies, and they need to verify the SSN on file. they should say "are the last four of your SSN xxxx?" If they don't, give them yours (only last 4). that should indicate you are not the correct person. Also, ask for their address, which they must provide by law. If they continue to call, write a letter of dispute requesting verification of the debt and requesting no calls to your residence. It is possible you are mistaken, so be courteous - they are only doing their job. Your phone number may have been this other person's previously, or you might have shared an address at some point in time. As long as you maintain a professional demeanor, they will too. Okay here's my situation. I'm getting harrassed which started back in 2008, and it started out with my friend, which by the way isn't her fault. She had no number she wanted to get a phone number a cell, which they needed a number for which she didn't have, thought that was the dumbest ever, she had just recently moved to the town I live in back then. So I gave my home number to Fido in our mall, as a reference number expressing that It's only to be emergencies for and so that my best friend could be able to get a phone. She knew she had debts but had little money to pay it entirely off. I won't go into that. But the point is niether of us knew until not even a week later I started getting calls for her for her debts when we knew Fido gave it to them, I read their privacy policy nothing in there whatsoever has anything to do with my case as to why they had a right to give out my unlisted number. No I don't want to change it, If I have to I rather sue them for harrassment as this is just plan rude of them. I've asked them nicely I've told them this isn't (used my friends first and last name). If I don't answer the phone they don't give out info except her debt reference number etc, I've told the collectors time and time again that this isn't her phone number, that its mine. They still call me, as if I'm lying. Which I'm not. I got another call about not even two weeks ago I insisted on speaking to a manager the guy claimed her was told him this isn't her number,etc. And ask to have them stop calling me, to remove it, he said he would. He didn't. Now some other people are calling I've got caller ID for a reason to filter calls period. And I know when they call my number as their always unknown and every time they ask for my friend, and I tell them again. I got another today. And Frankly it's not my friends fault. Since she didn't give them my number. I can't afford a lawyer but I am tired of their crap. I'm on low income single parent. I don't need this bull crap. Anyways if any of you have any idea's such as say info of not needing to pay for suing them for harrassment or whatever please say so here. |
