Has anyone filed bankruptcy without using a lawyer?
I've been thinking about filing bankruptcy using one of the websites that fills out all the paperwork for you and then all you have to do is bring them to court. they garuntee their work, if the judge does not accept them they will either fix the problem or refund your money. If anyone has ever used one of these businesses could you please tell me about your experience or knows of a good website to go to please let me know.

There are people who have filed bankruptcy on their own. But it is not as simple as these sites make it appear. Since they changed the laws in 2005 they have made it much more difficult to file for a Chapter 7, and there are a lot more steps that a person must go through. If you don't qualify for a Chapter 7 you will be forced into a Chapter 13. If you miss one step or do one thing incorrectly there is a chance you could have your entire bankruptcy dismissed. So you have to be very detail oriented in doing this.

Also, it does not matter if the company offers to refund the money you paid them. If your case is thrown out, you will not be allowed to refile for 6 months. During this time the creditors can start up the collections process again. Is that company going to help you during this time? If you feel that bankruptcy is your only option you should at least talk to a lawyer first. Most lawyers will give you an inital consultation for free. During this time they will let you know your options as to if you would even qualify for a Chapter 7 and what would be involved in filing.

I work for a Chapter 13 bankruptcy Trustee, and people who file 13s without a lawyer never make it. Ever. Their case is always dismissed.

If you really do have to file bankruptcy then you really do need a lawyer. The law is complex and you cannot do this just by filling out a few forms.

My advice to you is this. First, decide whether there really are any alternatives. Bankruptcy is the last resort and stays with you for a long time. The chances are that your creditors don't want you to file bankruptcy as they will then get nothing. You may be able to negotiate debt reduction and easier repayment terms.

Second, if you do have to file, consult a lawyer before you do anything. An initial consultation with a bankruptcy attorney is usually free. Check out this website which has a load of links that can help you make these decisions.

I think I've seen questions from several people who filed bankruptcy without a lawyer. Their questions all dealt with problems with the bankruptcy.

Get a lawyer. The rules have changed and are very complicated.

bankruptcy is not something you want to fool around with and I would never deal with someone that I couldn't work with face to face

Have you thought about debt management? They will help you lower the credit APRs on whatever credit you want done. My credit cards were giving me up to 20% and this one company which I've used before had it lowered to 9%. It's about how much can you afford to pay in a monthly sum, plus your credit is recoverable after you've finished all payments. Take the time to see if there's any interest.

Bankruptcy should be your last option. You lose a lot more filing than you gain. Your credit will be horrendous and you will over pay on any future loans. Sometimes you need to file, but often you can find other ways around it. It seems like a good, easy decision but the reprecussions are more severe.

I just filed bankruptcy a few months ago, you really need a lawyer, most of them you can pay in payments, it is very complicated and a lot of guidelines you have to fall into, file chapter 7 that way you don't have to pay back anything on non-secured loans like credit cards personal loans etc.....and you can only make so much a year to file certain chapters of bankruptcy....its the best thing i every did, Ive got places knocking down my door trying to loan me money now, I can still get loans for any thing at good interest rates even with the bankruptcy on my record, because you can only file every 10years and most lawyers are friends with the judges to! I just happen two be typing on my new computer that i purchased with credit, and got no interest for a year, and filed 4 months ago...it really helped me out..
