Hellp me please, i have a brother who dose not live with me and uses my address as his mailing address?
and he has debt collectors ringing my phone all the time threatening me ' can they legally do anything to me ? like try and take my stuff ?

**When they ring you just tell them that your brother can't be reached at your number and give him his phone number. They won't necessarily tell him that you gave them his number either.
As for his mail, I'd just write 'not known at this address' or 'return to sender' on the envelope and put it back in the mail.
They'll get the hint that they can't reach him through you anymore.**

My dear, you don't have a problem. Your brother does.

The debt collectors can't take your stuff or have you appear in court for his debts. You should clearly tell them that:

(1) Your brother doesn't live at that address and never has;
(2) They should cease and desist calling you as the debt is not yours;
(3) Remind them that any subsequent calls to your home will be promptly reported to the Federal Trade Commission (FTC) and the Attorney General of their state of business because they will be in violation of the Fair Debt Collection Practices Act.

Try this link. You can also send a written letter to the collection agency stating the same thing if they provide you an address.

Please note that if they continue, you should call the 1-800 FTC line for assistance and they will tell you how to report the activity so they can investigate.

One final thing: When you find your brother, you need to remind him to be a man, be accountable, and face his collectors instead of involving you in his folly.

You deserve better than to have to waste your time cleaning up his hot messes.

First, forward all his mail to his current address, and call each of these places yourself to ensure they have his correct information. Next, inform the phone collectors that they are now harrassing you on the phone and if they call you again, press charges against their company...document each and everytime one of them calls you and ALWAYS get THEIR names. No they cannot legally do anything to YOU. Then call your brother and tell him that he can no longer use your address or phone number and that he has to either use his own or your parent's

When they ask you do you know where I can reach him, give them his number. And KEEP all the mail in a stack, or write "return to sender" on it and throw it back in the mailbox.

If he has been using your name too, than you are liabel for whatever he spent. Tell him you are no loger going to allow him to use your adress and start marking his mail as "return to sender, not at this adress"

Not sure but I think it's against the law for collectors to threaten you or anyone. Consider researching your rights and when creditors call you remind them of their responsibilities/law.

Years ago I was threatened by a creditor who said they would ruin my credit if I did not pay. Someone told me, "they can't do that, yada yada ('cause I can't remember). The creditor called back and I said it. The creditor hung up and NEVER called back.

Write return to send, not at this address on the bills. When bill collectors call, tel them he doe not time there. Tell them they are harassing you, and give them legal notice to stop. Keep notes on these calls. If you have his contact info, including his place of work, give them that info.
