I filed for bankruptcy six years ago and when I was weighing out my options I was told that there was a way that I could keep my car and still file bankruptcy on it but there are certain conditions that have to apply. I ended up not filing on my car though, and bankruptcy laws have changed since then, so I don't know what those conditions would be. Talk to the attorney that is handling your bankruptcy or even see about getting a free consultation. There are also hundreds of websites with free information on the different kinds of bankruptcies and what you need to file. |

You can file BK and keep your truck - but only if the BK Trustee agrees to it. If you owe very little on the truck compared to what it is worth then the Trustee will take the truck and sell it and use the money to pay your other creditors.
If you owe more than the truck is worth you may want to give it back to the creditor and walk away from the loan. You would have to get another vehicle and finance it, probably at a much higher rate.
If you owe about what the truck is worth you can keep the truck and reaffirm with the lender - if reaffirmation is required in your state. Some states allow you to just keep making the payments without reaffirming the debt. Check the laws in your state to see. Keep in mind that if you keep the truck and continue paying the payments you will be lengthening the time it will take to re-establish your credit. The company you have your truck financed with will most likely mark the account as a derogatory account and will continue to report it that way as long as the account is open. This will keep your credit score low even if you make your payments on time.

If you are asking if you will be able to file bankruptcy, not pay any more toward your truck, and still keep it, then the answer is no.
What happens is you must "reaffirm" the truck loan and continue to pay on it. All bankruptcy does is allow you to turn the truck back without any further liability. Otherwise, they sell it and you would be responsible for the remaining balance on the loan. |

If you go bankrupt, file your bankruptcy under Chapter 13. Chapter 13 permits an US resident to reorganize and restructure their finances. It allows you start afresh and get your finances back on the track. The bankruptcy court will supervise and authorize the entire process of overhauling your financial situation. |

It's unlikely you can keep the vehicle with today's bankruptcy laws but a qualified attorney can help you. Bankruptcy is protection from unresolveable debt and you may end up with a repayment plan instead of a discharge anyway. I don't know the extent of your debt or income but check out the national organization for credit counselors below before you think about blowing $700+ on a bankruptcy |

Do you realize that you are asking a bank for a free truck. Your attorney will tell you, sure you can keep the truck,we just won't include it in the bankruptcy. If you have a typical auto loan, the loan is secured by the truck, which is why they require you have full coverage on it while you still owe money. If you could obtain an unsecured loan, you could pay off the truck and then file bankruptcy. They will ask you what the unsecured loan was for and if they find out it went to pay off the truck loan, well you might be in some trouble. |
