Help! The bailiffs are coming.?
I've offered what I can afford to pay but they rejected it so I've put it in writing and am waiting for a reply. If this doesn't work and they come to my home how are they allowed to get in? What can they take? What can't they take? Any Solicitors out there that can help me (I wouldn't be asking the question on here if I could afford one). Thanks guys.

RELAX, firstly the bailiffs must write to say they are coming, but that is only after a court has given them permission.
they are NOT allow to take anything that helps you earn your living, or anything that would be of detriment to a child's well-being,

Get in touch with a debt management agency asap. They will help you by contacting everyone you owe money to and getting your repayments lowered. At the end of the day though, if you own your house then you cannot say you are unable to pay your debts. You may have to face the fact that you are going to lose your house.
The citizens advice bureau should also be a priority visit!

Generally it is true, The bailiffs can not break into your home, Although what they can do is look through your window and make a list of the things they see. They will then make a list and post it through you door, which means these items become the property of the creditor and youare not allowed to remove them.

so make sure the curtains down stairs are closed

With regards what they can and can´t take, Generally they will try to tkae anything with a resaleable value although they are not allowed to take the things you need for Cooking and also if you have children they are not permitted to take your TV as this is not regarded as a luxury.

My Advice is Do go to the Citizens advice Bureau or Local Welfare rights office. Do not go to a private Debt advisory business as this will just compound your problems by lumbering you with more debt.


You have to speak with the Creditors (The people you owe the money to and also the bailiffs) Make an arrangement to pay either by weekly or monthly installments.

I would list how much money you have coming in and also what bills and expenses you have going out.
This will tell you how much money you have left each week or month.

Another option, and this is only if you live in rented accomodation
is to move.

Do not leave a fowarding address. This way the bailiffs and also your creditors will not be able to find you. Ok it would mean that you will not be able to apply for credit for at least the next 3 to 5 years, and if it is the bank that you owe money to then you will need a new bank account.
Just remember when you apply for credit in the future you will not be able to give your current address to potential creditors or banks.

What ever you do Do NOT LET THEM IN!! as once you have let them in they can then enter your home without your permission. Get advice from the CAB and hopefully they will be able to help you by contacting them on your behalf if you are sincere in wanting to make some sort of payments as you claim you have.

no the bailiffs cant break in, also they cant take things that you dont own, like catalogue purchases for example, so if they do get in your house just say that the tv isnt yours, that you borrowed it from a friend, and anything else of value you can say that you are still paying for from a catalogue.

For free legal advice, go to the Citizens Advice Bureau.
Don't let the bailiffs in, from my understanding, they're not allowed to break in.
But you do need to sort this asap, so keep pushing the people you've written to for a reply.

As for getting advice, I'm afriad the 'I haven't got time' excuse is a symptom of problem avoidance. You have to make the time. You will not get the magic solution on Yahoo Answers.

Your creditor can not take you to court with any hope of success if you have already made a reasonable offer to pay what you can because no judge will find favour with them if they are demanding more than you can pay. There are two reasons for this, firstly if a judge were to make a county court judgement against you it would only be to force you to pay because you were refusing to pay, you are not refusing so there is no need to force you to do what you are clearly trying to do already.

Secondly you have a right in law to pay your debts and if the people whom you owe money refuse to accept your offer then provided that offer is reasonable then they are at fault. If they continue to refuse for six years that debt becomes void.

What normally happens is creditors get greedy and try to get more money out of you than you can afford by using a debt collection agency. These debt collectors have no powers at all unless a judge grants them powers which will not happen in your case. The debt collectors then write official looking letters especially designed to scare people into paying more than they can afford. They can not enter your home unless you let them in, only court bailiffs who have been authorised by a judge can do that. Most debt collection agencies are not bailiffs, many of them are just dodgy businesses that prey on people who are in difficulty and many of them are less than honest.

I am in a similar situation so I phoned the debt collectors up and told them to get lost, end of story.

I then wrote to my creditor and told them they can either accept my reasonable offer or see me in court.

If you do what is right then no one can touch you.

yes same as all above. citizens advice. I swallowed my pride and went to see them. Tell them all your debts not just the bailiffs ones and they will sit and work out your incomings and outgoings then they will with your permisssion write/phone them all and arrange repayments that you can realistically afford. you dont even have to speak to the bailiffs. The people at citizens advice are there tohelp you and dont look down their nose at you they enjoy helping you and they see lots of people. When i told them whatmy debt was they said there were people withmuch bigger debts themmine and i left feeling better than i had in months. So bite the bullet and get down there.

they dont give warning, they arrive, clip board in hand, and are often very nicey nicey when you answer the door !! they come in and start jotting down on their clipboard what they can see, tv, video, dvd, electrical goods that aren't a necessity, they cannot take goods that you need, especially if you have kids (beds, cooker, washer, fridge,) If the item doesnt' belong to you they can't take it. The best bet is not to let them in, there are the bully boy type of baliff who you just don't answer your door to, as once it is opened they can get in !! Keep your windows closed too, in this weather it shouldnt be a problem.

Go to your local advice centre and they may be able to help sort things out, but you should act quickly. Take all evidence of cash you have coming in, and going out, they will take details and get in touch with whomever you owe money too and arrange a decent payment for you to make. You could get a lot of debts written off, I did.

Go as soon as possible. You can see a solicitor free for 30mins try ringing round your local ones, they can put you in touch with decent agencies to help if your citizens advice is fully booked up. You could also try your local council, they often have advice centres that deal with things like this.

The Bailiffs can only enter your house, if you INVITE them in. They are NOT allowed to break in the door, if they do, call the police. In fact, I would anyway, to tell them what the situation is and they will be on hand to make sure nothing illegal happens.
Your local Citizens Advice Bureau will be able to advise you on legal matters and may even appoint a solicitor for you.

If you own a car, they can clamp that and have it towed, so I'd think about moving it to somewhere they can't find too.
