Help what do i do collection agency atty frederick j hanna & associate took out $780 on my bank?
I talked to the associate and made a deal with them to have it taken out on the 21st of dec.not on this payday.I even ask for sure if they will really take it out on the 21st of december,and they both said yes (the manager and the associate).How can i be stupid entrusting them my debit card! Now i'm broke and need to pay,my rent.What should i do? I'm thinking of contacting them and have it stopped until my next paycheck comes in on the 21st of december.now i have to wait until tomorrow to talk to them.pls help.no BS pls!

Contact your bank immediately and tell them of this unauthorized automatic debit.....

I've always tried to warn people when dealing with collection agencies to never give them your bank transit and checking account numbers for debit payments...they'll raid your checking accounts...I wish you had posted here sooner....

Also, get all terms IN WRITING with any collection agency prior to paying them one penny. Pay ONLY via USPS money orders.

If you have proof in writing that they were not going to take the money out of your account, then you could (and you should!) very well sue them. However, if you don't and only had a verbal promise, I'm afraid there's not much you can do. They can simply deny any deal that was made between you and them.

But, like others above me have suggested, you should head down to your bank ASAP tomorrow and see what they can do. Maybe they can call the collection agency and have them put the money back into your account and take it out again on the 21st? It may be a stretch, but it's worth a shot. Collection Agencies are full of nothing but jerks.

But in the future, don't give your bank info out to these slimeballs. You don't want them to try and charge your account for anything other than what you owe them. You should just send them a money order or a check to pay your debts next time. Much safer.

If they have a judgment against you, there is nothing you can do. It is very unlikely calling them but you can always try. If no judgment, stop the payment at your bank as unauthorized. A fee of $25 is usually charged but worth it if it helps you cover your rent. My long term advice, run strictly on a cash basis, ie no money for them to take out of an account if non there. Starting paying them and others via money order. This can also be a helpful way for you to see where your money goes and help you with budgeting.

Call your bank- you shouldn't need to physically go down there to dispute a transaction. Tell them that you did not authorize the transaction and that you would like them to put a stop on it.

Personally, I would call the collection agency and tell them that you stopped the transaction and that you are no longer interested in cooperating with them. They will flip out and tell you that your life will end if you do not pay them (i.e. you won't be able to get a job, a place to live, a car, have a life, be capable of loving, be accepted by society, be able to sleep at night, or recognize yourself in the mirror)... just give them simple, controlled, non-emotional answers like "that's fine."

I usually let the collectors hang up on me. One good way to frustrate them is to suggest that they are advising you of what the "right" thing to do is. For instance, try a conversation like this:

collector: you must pay us

you: well, i can pay you but i will need to discontinue important medical treatment, have my mom kicked out of a nursing home, drop out of school, let my kids starve one night a week, etc... are you suggesting that i do that?

Usually they will get very angry when you ask them if they are "suggesting" that you do anything other than pay them. Another way to frustrate them is to try to get ALL their information (name, supervisor name, company name, phone number, address, fax number, email address... make them spell it ALL out and always ask if there are middle initials, PO boxes, etc). If you practice long enough you'll have the collectors WAY more pissed off than you are.

Of course the situation itself sucks. You owe money. If you don't think you will ever be able to pay it all, don't try to satisfy one this month, another next month... It'd be better to not pay any of them because otherwise you are resetting the Statute of Limitations each time you make a payment; in that case, when you finally do give up it will take that much longer for you to be legally clear of the debt (it will still be on your credit report for a total of 7-10 yrs though).

If you do end up unable to pay, live off cash so you don't have to worry about judgments against your bank account. You should also try to budget your life such that you can live off of only 75% of your wages in case those get garnished.

Why would you make a deal with a collection agency? That's what they do "collect". And they'll do it at any opportunity they can. They don't negotiate, once they have an in, they will collect whenever they can.

Borrow some money to pay your rent, and end your association with them.
