How can I get out of my auto loan?
I have a 2002 Explorer with 112k miles on it and still owe $12k due to my 18% int rate. Is there a such thing as a voluntary repo where I can just give it back? How bad is a repo on your credit report and how long does it stay on your report for?

A voluntary repo is exactly the same as a non-voluntary one. The lender will sell the vehicle cheaply at auction, then come after you for the difference. The repo will stay on your credit file for 7-1/2 years.

You would be better off to sell the vehicle and get a loan to pay off the difference.

Yes you can return the car--it's called a voluntary repossession. It is bad on your credit --which sounds like it's already pretty bad if you have an 18% rate..

They will sell it and come after you for the difference.
When you sell it, don't be surprised if the buyer wants to pay the bank directly. Most people want a clear title. They don't want to buy a title that you owe money on. They will think you will stop paying the loan.

First, any repo is really bad.

Second, if you return it to the lender and they auction it, you will still owe the difference between what they got and your principal balance. Giving the car back doesn't cancel the debt contract. You would be better selling it yourself. Pay any difference with a cash advance from your credit card. 18% isn't a car loan rate; it's a credit card rate.

You could probably get 8000-10000 for it, leaving you with only 2000 to pay. If they auction it they would get wholesale which might be less than 5000, which would leave you with 7000 to pay (or more).

You can't just "get out" of the loan, because all car loans go "upside down" at some point due to the rapid early depreciation. If they let you out, then everybody would buy a new car and then turn it in after a couple of years.

2002 was 6 years ago. How long a loan did you get, anyway, that you still owe 12000? What did you pay to start? What are your payments? I'm curious. I'd like to be helpful but the numbers in your question are strange. Fell free to email me and maybe I can think of something.

If you bought it used, it shouldn't upside down like this because the big depreciation is already gone. That would mean that it was upside down from day one because you paid way over what the car was actually worth.

Stays 7.5 years and then the company can turn you over to collections to collect the difference in what they can sell it for and the amount you owe. If they go to court and get a judgment your assets (checking acct, savings etc) can be attached.

You can surrender the vehicle to the lender. A repo is bad when it comes to getting financed again. A voluntary surrender is more favorable because it's less trouble for the lender than a repo. A repo is almost more deterimental than a bankruptcy when getting an auto loan.
