Negative information can only remain on your credit reports for 7 years only. If you have a bankruptcy, that will remain on your reports for 10 years.
ES is wrong, the amount of time negative information stays on your report isn't depended upon whether you paid off the bill. I'm living proof of that. I had credit issues in the past. All of my delinquencies occurred in 1999. Every one of those negative accounts have since been removed from my file and I did not pay off these accounts inorder for that to happen. I had one collection agency that tried to reage an account to stay on longer than it should. It took 2 letters and a complaint to the FTC to get the collection agency to comply with the FCRA rules and remove their entry from my credit file. I didn't pay the CA because the sol had already expired on the debt, and paying off old negative accounts hurts your FICO score rather than help. I don't advocate running up debts and not paying them, but due to life circumstances I defaulted on several accounts about 8 years ago.
If the negative information on your credit report is truly beyond 7 years old, I would dispute it as obsolete/past the seven year reporting period for negative accounts with any of the credit bureaus that has that outdated information listed. Check out the website creditboards.com. It has a wealth of information and the letters you'll need to write/type to the credit bureaus and any original creditor or collection agency that has reaged accounts to remain longer than they should.
Before you take any steps, you need to find out what the sol is for these negative items. You don't want to make the mistake of contacting these companies when you still legally owe the money. This could prompt an OC or CA to take legal action against you, especially if the amount of money you owe is greater than the amount of money you would have been granted for their FCRA violations. Some states have a sol that's longer than the 7 year reporting period for negative accounts. My state has a 4 year sol for credit cards (open end accounts), but Rhode Island has a 10 year sol for credit cards. If you resided in Rhode Island and defaulted on a credit card and you never brought that account current again, that account should only be reported to the credit bureaus for 7 years, but you would still legally owe the money for another 3. If the sol has indeed expired on the accounts that's over 7 years old, proceed to have them removed from your credit file. Learn the the FCRA and FDCPA laws, it's your best defense against OCs and CAs that want to violate the law. Good luck. |

I recommend credit repair unless you have lots of time and a high tolerance for aggravation. Some things are better left to the professionals. Usually companies charge hundreds of dollars to simply pull your credit and send correctly worded dispute letters—this is the key…..people will tell you that you can do this yourself for free but the truth of the matter is that the credit bureaus will throw your letters away or simply reject them. A similar kit is being sold via infomercials and radio talk shows for seventy dollars more but they try to solicit you repeatedly for other services after the fact. |

Follow Jan4's advice, and look at the link I supplied below.
What is happening is the collection agencies are "re-aging" the debt. When they receive it, many times it does not have the "delinquency date" on it, so they guess at it.
By law, negative items can only stay on your report for 7 years, beginning from the date of the delinquency.
Here is the problem you are going to have...when you file a dispute with the credit bureau, all they are required to do is "verify" the debt with the creditor. That means they contact them, ask if the debt is correct, and if the collection agent says it is....the report stays. No investigation ever really happens...no proof, nothing.
So guess how many times the collection agent verifies the debt? Always!
What you have to do is also dispute the debt with the collection agent, and demand that they "validate" the debt. This means they must prove the debt with contracts, bills, receipts, and other documents. This info will show the delinquency date.....and if its outdated they must delete the entry.
If they fail to do that, you can sue them for $1000 in small claims court. |

Just write a letter to the credit reporting agency (like Equifax, etc) and state the account info and tell them it's over 7 years and to please remove it as stated by law. They will remove it and send you a new report. They will remove it if the last transaction was over 7 years ago. You don't need any special forms. Just make sure all your info is at the top of the letter. And do it for one account at a time, otherwise they can say it's frivolous and they won't do it. This works because I've done it. |

It all depends whether you paid off the bills or not. If you haven't, it will stay on longer. If it is bankrupcy, I believe it stays on 10 years. If it went into collections, with different agencies, there can entries from the agencies as well as from the original company. If it is a true dispute, start with the credit reporting agency ( Experion- Transunion- etc.) they have a form you can fill out on-line to request the erroneous information be removed from your report. |
