How could a bank do this?
My bank is so stupid.Last night I checked our account and there was quite a lot of money in there when I woke up this morning.I was in overdraft.I have made 2 deposits to cover this amount and they are still hit me left and right with charge.They are saying that the charges are from april cause I cancelled the card because someone had gotten the number and the charges that were pending went back into the account no they did not and we are being charged again for them what can I do about this please help.

I have talked to the manager and they can't seem to show me.They say that the reason why is because the charges from april did not go though and the momney went back into the account I am not that wealthy that I would have notice an extra 400.00

Do you balance your account as you write checks or make purchases with your card? Never trust what you see online or on paper- statements are not updated to the minute. It is up to you to keep track of that.

Your bank isn't stupid. The charges are because at the time of the charge you were overdrawn-you made a deposit, but it was too late.

Yes, there are no firm rules on when the charges have to be applied.

I hated Washington Mutual because my electronic bank balance was fiction, it was never right. With Bank of America my balance is always right. Payments for bills are made at midnight and if I go into overdraft that is when the charges apply. They do hit me sometimes; I am poor and disabled so I don't have a lot of money.

Another problem is that if I make a deposit to try and cancel the overdraft and it isn't enough then I get hit with another overdraft fee.

You can complain that the charges were so far in the past you had thought they weren't applicable and so you shouldn't be penalized for it. You might get the fees reduced. If the problem is coming from Identity Theft then your bank should be willing to help you on this and make allowances.

If they can't show you the proper records to justify the charges then it might be time to hire a lawyer or at least talk with Consumer Credit Counselors.

go into your bank and fill out the forms to dispute those charges and dispute also the overdraft charges.

also talk with the branch manager about this

they will do an investigation...remember this will not happen over night....it will take a while....

Calm down, just take your paperwork to the bank with you and ask to speak to someone. Be nice because you want them to wave those overdraft charges! Usually they will go over everything with you and get it all straight. Good Luck!

do be nice about it, but ask for someone to please explain this mess so that you totally understand it....get to branch manager if you can...if they can't do it then close your account, and tell them your atty will be in touch..they HAVE to be able to explain it to you on paper, otherwise they will surely lose in court..good luck and don't give up!

If you had fradulent activity on your account you should not be held accountible. Go into your bank and explain the situation. Ask them if they could waive the fees. If they say no...ask to speak to the manager, most likely they will waive the fee.

When bank accounts are opened, the new account holder signs disclosures that give the bank the authorization to make these type of adjustments. What it seems they are saying is that those charges that were pending from April were found to be your charges so they were processed accordingly. Below is a website that may help you further. Get a lawyer and turn him loose. Let him find out what the bank did and whether it was improper.

Call and talk to someone other than the idiot who answers the phone. Call the branch manager and if that doesn't fix it go regional. I hope you have all of your documentation together!

What they are saying (if I understand the question which is a streach I must say) is that you disputed some transactions in April and the bank removed them from your account and now they have finished their investigation and found you to be at fault and put the transactions back thru your account. This is perfectly legal and your bank can do this. You need to request to see the verification they recieved back when they submitted the dispute. Many people believe once they submit a dispute and the bank returns the funds to your account you are all set...but what really happens is that the funds that were returned was a conditional credit based on what you told them. They turn around and ask for the money back from the company that took it from your account and they request proof that they were authorized. It sounds as if the place that took the money from your account sent adequate proof that they were authorized.

Go in and BE NICE and ask them to refund the NSF charges on your account and then make a deposit to bring yourself to a positive balance. Next time you need to dispute something please take the time to READ the form you are signing. Banks are highly regulated and they cannot just put things in and take them out at will, they are required to follow the laws set forth for them by they federal govenrment, and that is what your bank has done.

The bank can cancel your card, but you they still hold you responisible for charges placed there. Climb the bank's chain of command by going in there. Refuse to leave until they help you solve this problem. What they should have had you do was close the account entirely. If I were you, I would close the account. Open a new account either there or at a new bank all together. It will take your bank 30 to 45 days to dispute those fraud charges on your account. See if they will dispute it. I bank with JP Morgan Chase; they were very helpful when I had a deposit slip and an endorsed check go missing. They shut down the enire accout and put an alert on it, then opened a new one for me.
