How do I get the collection calls to stop?
They call my cell phone at least 10 times a day. When I ask them to stop, they say they cannot control the calls. The dialing machine does it. Then I ask them to send me proof of the bill in the mail and I recieve nothing! They are very rude and when I ask for a supervisor they hang up on me! I am trying to get my credit together because I am expecting and I need my credit to get back to where it needs to be. These bill collectors just won't stop. They are stressing me out and they call from 8:00am until 8:59pm non stop. Isn't there laws to protect consumers from such harrassment? Are they allowed to continuously call a cell phone at their will? Please help!

Next time they call, inform them of the following:

The FDCPA requires that debt collectors send consumers a written notice that includes, among other things, the amount of the debt, the name of the creditor to whom the debt is owed, and a statement that, if
within thirty days of receiving the notice the consumer disputes the debt in writing, the collector will obtain verification of the debt and mail it to the consumer. Section 809(a), 15 U.S.C. § 1692g(a).

You can also send them a cease and decist letter as per the following:

The FDCPA requires debt collectors to cease all communications with a consumer about an alleged debt if the consumer communicates in writing that he or she wants all such communications to stop or that he or she refuses to pay the alleged debt.
This “cease communication” notice does not prevent collectors or creditors from filing suit against the consumer, but it does stop collectors from calling the consumer or sending dunning notices. Section 805(c), 15 U.S.C. § 1692c(c).

Remember this, if they know you know your rights, then tend to back off for fear you might catch them violating the FDCPA

As long as they're not calling in the middle of the night, they can pretty much do what they want. There are laws, but they're rather vague.

If you have a bill, pay it. If you don't know of any outstanding bills, pull your credit report and it will say "COLLECTION ACCOUNT" really large on it. The longer you let it go, the more your credit score plummets.

The collection agency should've mailed you several requests for payment, have you changed addresses? If so, you need to inform all your creditors of the move... you may have forgotten one and never gotten the over-due bills. It happens to a lot of people, but just find out who is calling, what you owe, and pay it. Those calls won't stop until they have their money. They may settle for less than what it owed as well.

You need to do all this in writing, not over the phone. Send them a letter asking them to validate the debt. In the same letter, you can ask them to not contact you by telephone and they have to do it.

is this 1st party collections?.....if so they can call that much. if its 3rd party, then they are calling illegally.

What about turning your phone off, or getting a new one - or replacing the sim card, you deserve a bit of peace.

mail them a cease and desist letter by registered mail.
make sure you keep a copy of the tracking # from the post office.

simply work with them if you owe a debt the pay it or at least settle on it. you can also try sending a cease and desit but that has to be in writing to them. and then dont be surprised if they sell the debt to someone else. id recommend first finding out where the debt came from. if it is legit set up a payment plan something is better then nothing, that should help stop them from calling and help fix your credit.

Funny, I had something go to collection once. And for some reason they do not send you a bill. It was for a cable box that I forgot to return. They called for about 2 months, then after that I told them that their 7 years were up on trying to collect. Yes, the cable company waited over 6 years to send it to collection. (the cable company never called me).
I am looking forward to what answers you get.

Find out the dates. It could be over that 7 year limit. If so. make sure you tell them. You won't hear from them again. Then get a copy of your credit report and delete from there, since its over 7 years they have to take it off.

all you need to do is simply change your telephone #. i am in the debt settlement business and I reccomend my clients to do the same thing. You can check out crystalcreditsolutions.vpweb.com to see more. but change your number and they will all stop calling. just dont put your new # on anything. good luck

If you ask them not to call you, they should put you on a do not call list. You can contact the Federal Trade Commission, but make sure you document all the conversations, who you spoke with, what time you spoke with them, etc.
Also, don't answer your phone.
