 Will collector's actually sue me?
I owe over $130,000 and I no longer can afford to make payments. Some of it is credit cards and some of it is loans from Chase, Bofa, Capitalone and American Express.

How do I stop Capital One from scamming me?
I am in quite a bit of trouble with crapital one and I have no idea how to stop them from scamming me. They added charges that placed me over the limit and then charged me over the limit fees and continue to do so. I am considering bankruptcy. When you signed their agreement you gave them permission to charge you whatever their guidelines say. So stop whining and pay your bills.

They are not scammers, they are simply charging you the fees that you agreed to. Capitol-One is one of the largest banks in this Country, I deal with them every day and they are always going above and beyond to try and help people.

That's what credit card companies do when you are at or close to your limit.

Make a SERIOUS effort to pay the fees to get you below your limit (pay the interest, over the limit fees as well as the minimum, more if you can afford it).

By signing the agreement for the credit card - unfortunately you authorized them to do this. They are scammers - but you are NOT bankrupt!!!!

If you want some SERIOUS advice - and a way to turn your finances around - go to www.daveramsey.com and listen to an archive of his radio broadcast. Join a Financial Peace University class in your area - it will turn your life around and change your family tree! We paid off $18,000 in our first year.....our 2nd year we got beat up :) .....but now in our 3rd year - we'll be out of debt by the end of the year - only having $12k left. :) We make $50k a year and have 3 young sons - along with our oldest going to a private school......

You're NOT bankrupt - you can get out of this - it just takes a little bit!!! and trust me - IT'S WORTH IT!!!!!!

I've had an account with Cap 1 for years and never had any problems! Recently I had an outrageous charge on my card that I did not authorize that put me over my limit...which caused an over the limit fee. I called Cap 1, and they immediately reversed the charges, took off all interest charges on those fees and charges, and placed my card back to where it was!

So my question to you is were you close to your limit and possibly missed a payment? Because a fee for late payment would put you over, then you'd also be charged an over the limit fee. This is not fraud or scamming...it's what happens with any credit card company! You sign a contract giving them permission to do so when you got the card!

Every time I've ever had a problem on my card, I simply call cap 1 and they fix it! However, I'm sure if it was a problem I caused they would not fix it...because if I actually owed the charges due to being late or going over the my limit...then I'm at fault and can't expect them to take off the charges!

If this is the case then you just need to pay it down before it gets way out of hand! If it's already out of hand then you need to call cap 1 and figure out a plan! They'll help you if you ask, but they wont take off charges if you really owe them!

If the charges are fradulent, report them to the company. You can find the "dispute" address on the back of the statement. Dispute the charges in writing, send them certified mail, return receipt requested. Then call the 800 number and start asking people to drop the overlimit fee, you may have to go through several people to get this done.

Bankruptcy is very serious, and expensive in its own right. It costs almost 2k now, so if you can get yourself out of the mess with Capitol one with less than that, I would.
