If you have any proof that you loaned this person the money. Documnetation: a check written out to him, a signed agreement that he would pay you back. that would help your case. If not you should contact one of those TV courst shows Judge "Whatever" and have it tried on TV. |

First of all I hope got it in writing with his signature, if you do it's binding in any court of Law. |

As mentioned, $10,000 is going to be over the small court limit. You will have to file in Civil or District court (however your state organizes itself). It may require an attorney, as these courts adhere closer to the law and the forms are more complicated.
If you have any proof (letters, canceled checks, witness afidavits)...bring them along. Without a signed contract you have a difficult case.

The best thing to do is go to the police station and ask them what exactly to do .... they will know the right place for you to go and file a suit. Plus there advice will be free also vs going to a lawyer. |

you will have to take him to civil court....if you didnt make him sign some type of loan agreement then you wil be out of luck since you could not prove that you lent him the money |
