redmouse | How do debt collector works? |
I have an international friend who stayed for 3 months with me and now she left for her country with a bill from debt collector coming to my apartment.
She had a car accident which was her at her fault while she was travelling in US using a rental car. She didn't but the insurance from the rental company but her rental car damage was covered by her credit card. However, not in the case for the other car that she hit. Their insurance company wanted her to pay for all the cost. She told them that she is just a tourist in US and don't have any insurance and also told them that she was leaving States. Which she did after that. Now the Debt Collector sent her the bill to my apartment, which she used during her stay here for 3 months. What should I do? I have no involvement in the whole incident. |

I have to disagree with No White Flag and Echo....they are on the right track though.
If you send the letter back unopened, it doesn't solve the problem.
Depending on the state you are living in, they could file a lawsuit and deliver it to your address, which is the last known address of your friend. That would constitute a legal service, and they can get a default judgement awarded. Note that this is in only a few states, but it's best to cover yourself.
Send the letter back to the collection agent, along with a letter from you explaining what happened. Be sure to say that she has left the country and left no forwarding address, and you have no way to contact her.
Send this by certified mail, so you have proof it was sent. In the event that they should file a lawsuit and get a judgement, that letter will prove they did not make "a dilligent search" for the defendant, since they knew your friend no longer lives here and is out of the country.
That should cover it...good luck |
