Start using prepaid cell (the rates have come down a lot)...When you register, do not give out your real name so that you won't be in a database. DO NOT call them from your cell phone...call them only from pay phones so that they won't record your number. |

I work in customer service and once you share it with someone else then you they call you.. Unless you give debt collectors permission to do otherwise, they can only contact you under specific conditions and during certain times of the day:
They can contact you at your place of residence by phone, mail, in person, by FAX or email during reasonable hours such as between 8 am and 9 P.M..
They cannot contact you at any unusual time or place or a time or place known or which should be known to be inconvenient to you.
They cannot contact you at work if your employer disapproves and they are informed of this fact by you or your employer.
The short answer is yes! If you provided your cell number on the credit application or to the creditor as a means of contacting you, then collectors can call your cell phone. The only way to stop them from calling you on your cell phone (or any other phone) is to send a "stop calling letter".
And a 3rd party contact is most likely how they got your new phone number
Collectors are allowed to call third parties to verify location information. This means they can call your family, friends, neighbors and employer. However, the information they reveal about you and themselves and the questions they can ask is strictly limited by the FDCPA. When contacting third parties they must identify themselves but not state that you owe any debt; they can say that they are confirming or correcting information they have about your location, address, phone number, and employer only. They call people with the same last name as yours that they find in the phone book. They act like they are a friend that has lost contact with you. When they find someone that has your cellphone number. They make it sound like their an old friend that has lost contact. So then the person they called gives your cellphone number. Not knowing they just gave your cellphone number to a collection agency.
It's the oldest trick in the book. When they call me looking for a family member. I just take their information and tell them if. I happen to see the person I will give them the information. I never give out family or friends information. Because I wouldn't want it to be done to me. |

Ok a few good answers on this already, I especially like the detail on the FDCPA guidelines. You can indeed send a letter asking them to stop calling. You can send a "Cease and Desist Letter" which means stop contacting you completely. I only recommend this if they are seriously harassing you. As a former collection agency owner I know many of the games that some unscrupulous collectors try to play. Most collectors will not intentionally break the law, but they may have seen a fellow employee try a tactic that worked for them and now they are going to try it. The comment about calling through the phone book to find people with the same last name and asking for ways to contact you is not illegal, pretending that they are your friends IS ILLEGAL!!! A fine line, but a line just the same. I would always say to contact the agencies and try to work something out if you legitimately owe the bill. If you cannot afford to make arrangements then tell them this, so they can document it. When you can finally make the payments, settle or pay the balance you may be in a little better favor since you have been up front and honest. I would not give out work information, such as name and number for your employer for obvious reasons. Should they contact you at work I would ask them to no longer call you there as to not cause any potential conflicts with your job. Give them a different number, or ask that all correspondence be by mail.
Hopefully this helps and you are able to get your credit straightened out. The best thing is to face these problems, because they won't go away just because you don't answer the phone. |

Depending where u live, it ILLEGAL for them to call a cell phone peiod... MORE illegal if their calling your cell phone and not using a toll free number... This happend to me and they Sufferd BIG TIME!!! i mean this in the most polite way but. "People start learning your rights when it comes to collections" My collection all started due to sickness and lack off work.... |
