Yes,what account? Worse case scenario, they can take you to court. But if you have NO income and no assets, there is nothing they can do. I don't think they can touch your disability any more than they can touch someones social security. The only exception would be to collect on a student loan, and that can be written off in case of a doctor attested lifetime disability. If you are served, you may have to copy some info. and either take it to court ot mail it in. But the truth is that you can't get blood out of a turnip. Good luck. |

I'm no attorney but here are some thoughts as I understand the rules, etc. utilized by collection agencies. First, determine what the laws are in your state: i.e. the statute of limitations on bad/charged off debt. You can be sued in court up to that date. Many collection agencies (debt purchasers) will often sue in court for an old date that is out of statute of limitations in hopes the defendent (you) will not challenge them in court. If you are sued you MUST go and defend yourself either alone or preferably with an attorney. But SHOW UP and demand PROOF you owe the debt. Quite often, if the debt was purchased by a collection agency, they do not have the orginal paperwork to prove you owe the debt. So you at least have a fighting chance. But if you do not go a judgement will most likely be made against you. Then, depending on your resident state laws your assets may or may not be seized. Laws, etc. vary from state-to-state regarding what creditors can and cannot do to collect a debt. Once a debt is 'sold' or moved over to a third-party debt collector, then their ability to collect the old debt is much diminished. The key to any potential lawsuit is, again, what the statute of limitations for suing on a debt is for your particular state. You can find out by simply typing State Debt Statute of Limitations. I also strongly suggest you read the Fair Debt Collections Practices Act. Again, simply type that into your search. This will give you the information you seek regarding what collection agencies can do, etc. Also, check out the Budd Hibbs site: wwwbudhibbs.com. He is a consumer advocate against the abuses of collection agencies and has a tremendous amount of info on what to do, what they can do, what they try to do, how to fight them, etc. It is a terrific resource. You can also find the info there on the Fair Debt Collection Practices Act, etc. Check them out. Good luck but don't give up hope. We all go through tough times. It gets better. |

most of the time they will put it on your credit line which would make it harder to buy anything major (car,house ) or anything that would require a credit check. it also depends on what they are trying to collect on . if they take u to court and your only income is disability, the most they can do is get a judgement on u , yet u need to let the judge know your income, he/she may ask what u can pay per/mo. if it is the IRS they can as much as put u in jail if u cannot pay. |

Probably not if your income is only Social Security disability. If its private disability insurance they can attach the account. You are, as they say, "judgement proof" as there's nothing to pay a judgement with. That doesn't mean they can't bug you constantly, though. |

in my state you are judgement proof. also if you have any bank accounts they must let you keep 1000.00 for yourself. they can only freeze what you have over that. i think freezing accounts is a last ditch effort to get something out of you. also they cant go after ssi or retirement pensions. check your state laws on garnishment. they cannot take property on unsecured loans ie credit card debt. ive have seen where if they get a judgement they can attach liens to your house. its common with medical collectors and some cc comps. what that means is if you own property and they put a lein on it they get their money when you or your relatives sell the property. |

Most collection agencies will pull everything they can out even though the majority of the time it's just an act to scare you. However, if a judgement is made against you then your bank account will be frozen... even if you have more money in there than you owe! So if you have $500 in debt and you have $1,000 in your bank account you can't touch any of it until everything is done and the collection agency has their money. This happened to me, I moved to a different state and just forgot about a debt. Well the collection agency wasn't able to track me down apparently to let me know I was being sued. So about 4 months after I moved, I had about $2,000 in my checking account... I went to make a withdrawl and they said my account was frozen. All of it, even though I didn't even owe them that much. It took several weeks before the rest of my funds were available to me. Put me in a huge bind!! I would drain my accounts if you suspect any court action. |

Most of it is intimidation tactics, but if you have any money in a bank account, the bank will violate your privacy and give it to them, emptying your account.
They will try to get judgments against you, by having people coming around serving you in person. The sad part is that most attorneys will not give you competent advice, and really won't be on your side. You'll actually get better advice on Yahoo Answers than from most attorneys, in my humble opinion. |

It is seriously time to consider bankruptcy. If they sue you they can get a judgment againsts you, any assets you come into in the future can be garnished or siezed...even your tax return. If you have equity in your home they can attach a lien to that. |

as long as you have income, you are obligated to pay your debts...it's not easy and those people can be mean and heartless...the best thing you could do is to call a debt reduction place and let them negotiate with the collectors on your behalf to get the debt reduced for you...it's a horrible mess once it goes to collection...sorry it happened to you...good luck... |
