Yes, it's called the statute of limitations and varies by State. This is the legal time they have to sue you and get a judgment in court.
They can always sue after the S.O.L. has expired but all you have to do is show up and show the court that the S.O.L. has expired and the case will be dismissed. |

They can try as long as they like. However, they can't legally sue you for the debt after the statute of limitations for the debt in your state. Depending on the debt, the state you live in, and the state where you aquired the debt this can be anywhere up to 15 years, but is normally only 4 to 6 years. They can try to sue you after this, but just show up and state that the statute of limitations has expired. The judge will throw it out. |

A long time..But it can only be on your credit report for a limited time (Usually 7 years) after you have contact with them, and that's all that really matters. Eventually they will sell the debt to another company that will hound you. I got a letter from a company that bought a bad debt from a credit card I had in college about a year ago. I am 34 now, so that was 16 years ago. When you get those letters, send them a letter back CERTIFIED RETURN RECEIPT immediately saying that you don't believe that the debt is you in the first line, then cut and paste in a nasty Cease and Desist letter:

as the rest of it. That will tie their hands unless they decide to sue you.
If it is on your credit report already, send them a cease and desist. Wait untill you have the return receipt, then contest it on your credit report. Legally they can't reply to the credit bureau about it, and it will come off.

Depends where you live. In Canada, there is a time limit of 10 years without any contact with the individual. That means you have to not physically speak with the person, even a "hi this is so and so" for a full 10 years before they will write it off. Typcially, legal action would be taken far sooner than that though. |

In the UK an agreement signed before 1 April 2007 may not be legally enforceable, so if you live in the UK you should check when you took your agreements out. Then get help from the website. |

usually they refer the matter out to debt collection agencies and they only get paid if they collect - so they will keep chase |

Im not sure how long they will chase a debt personally, but I do know that they can pass the debt over to debt collectors who will then come to your house.
If you phone the credit card company, they will usually arrange a payment plan for whatever you can afford (even 1 pound weekly) so that it doesn't get as far as debt collectors. |
