How long can something remain in credit without being paid before they can not garnish your wages for it?
I have been paying a credit company $100.00 per month for the last 3 years. Voluntary wage deduction. Now that I am almost finished paying for those they send me a letter saying that i owe them another $1400.00. I had them send me copies of all the bills paid and unpaid and there are some going back to the beginning of 2004. why were they not added to the first set and if they have been unpaid for this long can they really come after me to pay those bills that are more than 4 years old?

Short story yes they can because by paying them you reset the statute of limitations.

Derogatory accounts show on your credit report for 7-years from the date of first delinquency and can not be reset lots of people get this time line confused with the S.O.L. which varies by State and type of debt and can be reset by paying or admitting the debt is yours.

Honey this sucks,

The statute of limitations in most states is 8 years, a little different from the previously thought 7 years. But there is more to the process than that. First you must be sued, you'll have the opportunity to show all your receipts to the judge. They must then win the suit. Then they can execute on your wages. If they don't sue you, or they don't win they CANNOT garnish your check. One little slimy thing that can happen... The statute of limitations can be renewed if you make a payment to that bill. i.e.- you make a payment for another bill but do not direct where that payment should be applied to, debt collectors will always apply payments to the oldest debt first as it renews the statute of limitations. So when making a payment always:

-Pay with MO or Credit Card, Never check as they can garnish you bank, and will use the info you've provided on your check.
-Always specify which debt the payment is for.

did you ever get any of these agreements in writing? if you did, and you are paying as agreed, nobody can "garnish" anything. also, a garnishment is a result of a court judgement...it cannot be imposed by a creditor without one. did you give the creditor access to your bank account? i hope not. delinquencies are reportable for 7.5 years.

Pal , I know how it is to have no money , and to max out credit cards . Please , see a lawyer . The first consultation is usually free . I did , and now I don't have any of those harrassing " automated " phone calls .

Wages can't be garnished without a court order. Most credit companies just send you to collection which does stay on your credit forever, unless you dispute it and win (it can be done). It's just a hassle, but the sooner you jump on it the better. Your balance can and still will accrue finance charges and years down the line, you'll have to deal with it.

7 years is the period of time that something can remain unpaid in the UK after this time they can no longer chase you for the cash. Not sure about the states but I would say its probably the same.

It totally and completely depends on whether or not you have defaulted on the account in the past.

If you default for 180 days, your 7 year negative reporting period begins the day of that 180 day default. If you have never defaulted, then your potential negative reporting period has not begun yet and if they send you to a collection agency you'll have wasted lots of time and money over this and have nothing positive to show for it.

Never pay a collection agency. It doesn't improve your credit AT ALL. It's as bad as flushing money down the toilet.

Any company can come after you for old debts, but if you'd defaulted at some point in the past (even if you are currently paying on the debt) they probably could not legally file a lawsuiit after 4 years. Each state has a different statute of limitations for legal action concerning revolving debt. Do a little research and find out what your state's statute is. However, if you don't pay them, this WILL hit your credit report. Always keep that in mind.

However, they should have added those unpaid bills to the first set. If you kept your original paperwork for your voluntary wage deduction on the original amount owed then you can use that as leverage. They cannot charge you $1400 more if you have the total amount owed from before in writing. Even if they made a mistake, it's their responsibility to have an accurate record of all debts the first time around. Send them copies of this along with a letter stating that if they attempt to collect this amount you will file a lawsuit. (and you'll win).

If it comes to it, you may want to consult with an attorney, just make sure you don't go to a bankrupcy attorney for issues involving credit law. Many people make that mistake and discover that bankrupcy attorneys are NOT credit attorneys and do not have the knowledge and information a credit attorney would have.

Edit: Making a payment on a defaulted account does NOT reset the SoL in ANY state. That is a myth. Also, the reporting period for negative debt is 7 years from the date of first delinquency, not 8 or 5. It's a federally regulated statute that you can research yourself by pulling up a copy of the Fair Credit Reporting Act
