Read Creditease's reply, it explains exactly what the law is. Note that the 7 year period begins on the date that you became delinquent on the debt, NOT on the reporting date, charge off date, or any other date they try to place on it.

What you need to do is dispute this report, especially if you know (and can prove) that the debt is not owed by you.

First, you need to send out some certified letters. Send each of the credit reporting agencies a letter to protest the entry. They will have 30 days to verify the debt and report back to you.

Also send the Creditor a "demand to validate" letter (see the link below). This letter demands that the creditor must supply you with copies of contracts, bills, receipts, and everything that was used to show you have a legal obligation to pay this bill. If they do not send you this information within 30 days, they can not legally post anything to your credit report.

If they do not validate your debt, send another letter to the credit reporting agency demanding that they remove the entry due to "lack of validation".

If it's still reported, you have an excellent small claims lawsuit against them. It's easy to file and doesn't cost that much.

It will stay on there as long as it is not paid and then another 10 years for it to be completely dissolved off your record. Get a copy of your credit report and then contest this, you can always put a note on the credit report but it will stay there, bring your credit score down. If you don't owe them, and you can prove it, did you know that you can sue for a ton of bucks for runing your credit report???? You Bet you can. Courts take this very seriously!

According to the FCRA:a) Information excluded from consumer reports. Except as authorized under subsection (b) of this section, no consumer reporting agency may make any consumer report containing any of the following items of information:

(1) Cases under title 11 [United States Code] or under the Bankruptcy Act that, from the date of entry of the order for relief or the date of adjudication, as the case may be, antedate the report by more than 10 years.

(2) Civil suits, civil judgments, and records of arrest that from date of entry, antedate the report by more than seven years or until the governing statute of limitations has expired, whichever is the longer period.

(3) Paid tax liens which, from date of payment, antedate the report by more than seven years.

(4) Accounts placed for collection or charged to profit and loss which antedate the report by more than seven years.(1)

(5) Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years.

7-10 years, but if you have your credit opened for ANY reason, even for your own curiosity, it could create activity on those unpaid accounts...then the 7 years starts all over. PAY THEM AND BE DONE WITH IT! Good luck!

Depends upon the amount and type of the entry. Small revolving accounts (i.e. $1,000) or less are 7-years. Over $1,000 is 10.

Bankruptcy, Foreclosures, Reposessions, Settlements, etc. stay 10 years. 2nd Bankruptcies can stay longer.

Judgements for Civil penalities (i.e. Fines, back child support) and taxes are permanent until paid and the court specifically removes the entries.

It can stay up to seven years, but you need to file a dispute with Experian, Equifax or Transunion. You might go to freeannualcreditreport.com and it will let you get a copy and also file a dispute.
