Congress enacted federal legislation that regulates debt collectors and collection attorneys and protects the rights of debtors. This law, The Fair Debt Collection Practices Act, requires that debt collectors and attorneys stop phoning you at home and at work once you ask them to stop.
Just Say to them :
I understand, but I simply cannot pay right now. It is a waste of your time and mine to keep calling me when I can't pay. I am requesting that you not contact me by phone in the future. I do not want to receive any more calls from you at home or at work and am asking you to communicate with me only in writing.
If the debt collector refuses to comply with your do not call request you will have to quote the actual law:
You then say: The Fair Debt Collection Practices Act requires that you stop phoning me at home and at work once I request that you do so. I intend to send you a certified letter tomorrow putting my no contact request in writing. If you continue to phone me, then I will file a complaint with the FTC and the attorney general."
NOTE :The Fair Debt Collection Practices Act does not apply to original creditors, like a credit card company;
BUT IT DOES apply to debt collection agencies and attorneys collecting debt. Therefore, do not quote the FDCPA to get original creditors to stop calling. Instead, quote state law which governs original creditors but usually has similar provisions to the federal legislation. |

A lot of credit agency has a code of conduct and many do not go by it as they rely on the fact that the consumer is ignorant. Find out what it is and whether they are are in breach of something to do with your and their contract. Read the small writing and you will find that they all lie about interest rate anything then complaint while you write a complain to them they can't stick on further apr it is illegal (in England anyway) |

Whatever you do pay everything current first.The stuff that's in collectors hands is most likely already on your credit report.Pay what you can,if you don't have, it you don't have it.
You can write them a letter and they have to stop contacting you regarding it. |

Are these creditors or collection agencies? Big difference there in how they are governed.
If they are creditors there isn't much you can do, as they are not covered under the Fair Debt Collection Practice Act. Now there are a few states that have adopted their own version of the FDCPA that includes creditors as well, but you would have to check to see if your state is one.
If these are collection agencies then it's much easier. A simple cease and desist letter sent certified mail will put a stop to it. Simply send the C&D letter stating that they may only contact you by mail.
Edit: Kate and Beverly are incorrect. If they read my answer they would have saw I said send them a cease and desist letter stating they may ONLY contact you through the mail. This is perfectly legal and they can still mail you things.
They're especially not gonna sue for $25 like Beverly said. Hell, they'd lose money just going to court and filing a suit. That's absurd, then again this came from a collection agent so I'm not surprised. |

Daniel is correct and also remember: NEVER EVER tell them to "cease and desist" as the account will immediately be sent to a legal firm to come after you for the debt....even for $25. The thing is, these large, evil firms buy accounts for pennies and have nothing better to do.
It's all a bigger issue, but you have to work it out. Most of the time they seriously want to help you, you just have to be willing and open to sacrifice. |

I work in collections. After reading the responses here so far, here is my 2 cents.
First of all consumer credit counseling programs are not a good idea in my opinion. I have known their clients to get in major problems due to the agencies not paying correctly. Example: One customer signed up for this, paid $1000.00 per month for 9 months to the agency- The agency held all of that money waiting for the creditors to charge off the debt- their intention was to make settlements with the creditors. Instead the customer was sued & is having problem getting what he did pay to the agency back.
By telling them to stop calling you - basically they will then have no option but to sue you. Once they gain judgment they can garnishee your wages. This tears up your credit.
Best thing is to try to set up small payments that you can live with (make sure to make them on time every month.)
As a last resort- bankruptcy- chapter 7 takes away all debt but you have to qualify - Chapter 13 allows you to pay back a small portion (maybe 10%) of your un-secured debts over a 5 year plan. It does ding your credit but it shows that you are making an effort to repay & gets the creditors off your back. They are not allowed to call you or garnish your wages.
P.S. to Crazyjes- I did not say that they will sue for $25.00- Question doesn't state any amount - however it states he wants to pay them one at a time so obviously it's more than $25.00.

You CANNOT get them to leave you along unless you set up payment plan or pay them.....You need to grow up....ignoring your responsibilities to debts is very immature and unfortunately many people have no idea how to budget, pay bills or handle credit. Since I don not know how you arrived at this state of affairs, I am limited as to advice......Oh and yelling at them only makes them come at you faster and harder.....it doesn't work, you look stupid, ignorant, uneducated and like a lazy person trying to skip out on debt.....
However, generally you must contact all of them and set up pay plan and STICK to it......If you are really so strapped, you should go see a bankruptcy lawyer - free consult and explore options.....This bills will not go away unless paid...they can also get jusgements and attach to your credit and then you will be in bad state.....Please work on paying these off and seeing a lawyer........
Stay away from consumer credit counseling services, they make it worse and out you further in arrears ....and it is a death sentence when you try to re-establish credit....no lender will lend to you, looks worse than bankruptcy.... |
