How to recover money that was borrowed to a friend who refuse to return?
i borrowed a total of $4.5K over nov'06 and dec'06. i kept asking for the money to be returned, and was given all sorts of execues and now..this friend is uncontactable or have been avoiding my messages, emails and calls..tried calling the parents, but they just sounded not concerned..anyway i can get the money back?? can this be reported to the police??

I was in debt collection for 3 years, friendly loan is the worse case, for it by collection or throught legal. As normally you don't have any proof on the loan, thus by taking up a civil suit may ended up with nothing but only incur more legal fee.

The Police will only advice you to take up a civil suit.

Thus, if I borrow money to a friend, I will make sure he or she is contactable, and I will ask them out for coffee one day before his/her pay day. So that they will have no excuse such as no money to pay back.

Another trick you need to learn, when people borrow money from you, they can be very "thick skin", and when you ask them to pay back, you need to be more "thick skin" than them.

You can however sue your friend in a court of law {probably small claims court}, BUT without a written contract simply explaining the terms and conditions of the loan -- it would be your words against his.

And even if you get a judgment against your friend -- he is as broke as an 8-track tape player! He can't pay it!

The moral of the story is that as a friend, you are NOT required to be a personal banking/loan center. If the spirit moves you, you can only GIVE what you HAVE and furthermore, you shouldn't give what you can't afford to lose.

Sounds to me like you can't afford to write off $4,500, but honestly what you should've have given your friend instead was wisdom, advice, and encouragement.

That way, you don't have to see how bad his character really is when he treats YOU like the rest of ALL of his creditors -- which is probably why his creditors wouldn't loan him a dime.

You don't borrow something TO a friend. You borrow from a friend. You lend money TO a friend. Your solution is easy. Since no one would ever loan money in the thousands out to someone out without some sort of written contract, file a claim in court with your contact as evidence. A judgment will certainly be ruled in your favor.

I don't think the police has anything they can do about it. The best they could do is suggest you bring them to court by filling a civil case against them.

As to the probability of collecting said money, it depends upon the sufficiency and reliability of proofs and documents to support your case.

Having a written agreement signed by both party, will be to your advantage. If no legal or written document is available , you could still bring them to court. Verbal agreement are still binding but you would have a much harder proving it.

sounds like an expensive lesson. If you have any PROOF that the money was lent and the expectation was for it to be returned then small claims court is your only chance. Otherwise - too bad for you.

try to get a claim aginst the family home or something for collateral for the $$.
Legal aid is out there, no fee if they don't win. If the parents are notified of what is going on from the legal profession, it won't be an oh well attitude anymore.

Lesson learned I hope!

if you lent it, without a written contract, then you're an idiot, and you are screwed.

if you have a written, not spoken, contract, take them to court. otherwise, as i said before, you are screwed, and you will not see that money again. it's great that you have all that money just sitting around....

he's not much of a friend, now, is he? can i have some money? i promise i'll pay you back....

You can't report it to the police as you did give it to them, they did not take it without your permission. However, you can take them to small claims court for the money. Your chances of winning the case will depend on how much proof you have.

If you have a written agrement that is your best proof. If you don't have a written agrement but some cancelled checks that would be okay if you can make a case that they agreed to pay it back. If you for some reason gave cash with no agreement you are probably not going to win as it is your word against their word with no proof.

Neither a lender nor a borrower be. The quickest way to lose friends is to lend or borrow. Its not a police matter. Try pursuing the matters through the small claims court if you have such a thing in the States.

I'm thinking you really meant that you loaned $4.5K to your friend. Was there an agreement on his part to repay? Over how long? Was this agreement written, or a 'gentleman's handshake?'

There are legal aid attorneys who might pursue your case; another poster mentioned that if the family of your 'friend' heard the word 'legal' they might be more inclined to take this a bit more seriously.

Hope you don't have to chalk this one up as an expensive learning experience. Can you afford a lawyer? If you have ANY indication that this money was NOT a gift (tax records?), your case might be strengthened.

a sort of illegal way is to steal something of great importance and hold it hostage until they pay or pawn it

depending on the lown agreement you might win in court so if your efforts don't work i would call the police

I have learned this the hard way and now i would just like to give you a small piece of advice. When lending to ANYONE, read the words ANYONE, make sure you have something in writing or else bare minimum make a recording of the same on audio or a video or click a picture of you giving him the money. But the best thing to do is to actually get the terms in writing. The way i do it is simple, i will specifically ask them for a date by when they will return the money. And in the contract i will include a clause where if the money is not paid by that date, interest will be charged. And at this moment usually the date of repayment from next week will jump to next month and if this happens you can be sure you need to think about giving your money to this PERSON. Because very evidently they are just waiting to get the money from you and scoot. Hence you only stand to gain in the end even if you are to take him/her to court. Basically, the court requires proof. And if you have proof, you will win the case and you will get your money back.
