How to stop Debt collectors?
For one debt I owe approx 500$, last month I sent in 500$ wich was half my balance. I still have no income, and have told them that. What bothers me is the week after I sent in the 500 they called me back asking me to send in more. I said I cant. Then I was asked how I came up with the 500 i sent in, I told them I borrowed it. They asked me to borrow more from someone, I said "how about you, will you loan me 500" to my suprise he said no..

anyhow he keeps aking how I come up with money to eat pay cell phone etc..etc.. fnally i get annoyed my him and say "the tooth ferry paid my phone bill" and "a leprechaun leaves me just enough gold to pay for food".

I tell him to stop harassing me by phone and only contact me by mail. he says he has the right by law to call me by phone.. By reading over the Fair Debt Collection Practices Act i believe i do have the right to tell him to stop calling..

You need to come up with a plan to pay this back. They generally will get off your back if you have a plan that they can work with. For example, if you can work in your neighborhood mowing lawns every weekend at $10 per lawn, and do 10 lawns -- that wll be $100 per week. Take out expenses of gas and food for the day, and you can send them $75 per week. You will have the debt paid back in 10 weeks, with interest, and then they can stop calling you.

As to the Fair Debt Collection Practices -- you can force them to stop calling you, and they can take you to court for not paying your debt. If you don't want a judgement, make appropriate arrangements to pay back the debt.

Then work through it and complete the steps you proposed.

Much as we want to complain about debt collectors, they are only doing their job. Most would rather not have to give you a call a second time. If you make arrangements and KEEP them, they won't usually bother them.

I believe you are right. If you ask them to stop calling you then they have to stop calling you. You read the Fair Debt Collection Act so just let them know according to this I have asked you to stop calling me and you need to stop. If you continue to call me I will have no choice but to report you. I don't know something along those lines.

Yes you do have that right. Put it in writing that you should only be contacted by mail. Also as long as you send them $5.00 a month and they cash the check, there is nothing they can do to you because you are trying to pay your bill and they accepted the payment. It's none of their business how you pay for anything and you can tell them that too!!

Next time tell him you will contact your lawyer if he continues to harrass you and stress the word "harassment" to him.

He can call you, but you can tell him when and where. Don't send them any more money unless it's to settle the debt, and then have the deal in writing.

send them a letter certified re tun receipt requested and ask them to stop calling you make copies of everything you send tell to contact you by mail only at least that way you have a paper trail and not a he said she said sort of thing.You do have rights under the FDCPA.

Under the Fair Debt Collection Practices Act, you do have the right to tell them to stop. However, it must be in writing. You can send a 'Cease & Desist' letter by certified mail, that should keep them quiet. Once they receive this letter they cannot call you or they will be in violation of the FDCPA.
They can only contact you if they decide to terminate further collection activity or if they may or are going to take further action. Just be aware, that while this is good to keep them from harrassing you, you could be forcing their hand to seek legal remedy.
For now, just pay the best you can and don't bother with anything else.

He has a right by law to contact you. But you also have the right for him to stop calling you!. Just simply mail the agency a letter preferbly by registered mail with returned receipt. And state in the letter for him to stop calling you by telephone. After he receives the letter he cannot lawfully contact you by telephone. You shoud refer to the Federal Trade Commission web site or you state attorney generals website for a list of unlawful debt collecting practices!

They do have the right to call you, but they can not, by law, call you at a number which you have informed them you cannot or are not allowed to receive calls at. If you tell them not to call you at a certain number, you MUST provide them with a number you can be reached at.

Your sarcasm toward these collectors will only fuel their fire and they could end up contacting the creditor saying you are uncooperative and advise them of their rights to file suit against you.

You can stop the calls by writing to them with a payment plan, stating your valid hardship, telling them how much and when you will be able to pay, and STICKING to that plan. They then have 30 days to either reject or deny your offer. If they deny you, they will write back with another offer, but *do everything in writing*.

Use your caller id and let the machine pick up the call. If they leave anything on your answering machine beyond their name and phone number, they are in violation of the FDCPA for third party disclosure, which can be upheld by you in court should it go that far.

You can stop a debt collector from contacting you by writing a letter to the collector telling them to stop. Once the collector receives your letter, they may not contact you again except to say there will be no further contact or to notify you that the debt collector or the creditor intends to take some specific action. If the debt collector violated the law, you can file a case against them in the state or federal court within a year from day the law was breached. You can get the compensation for the damages you suffered as well as extra amount till $1,000. You can also be awarded the court costs as well as lawyer’s fees. You can also join a group and get damages till $500,000 or 1% of the net worth of the collector whichever is lower. You can contact the state Attorney General's office and the Federal Trade Commission for reporting any problems you may have with the debt collector. They can inform you about your rights under the debt collection law of the state.
