If you are in the USA, it is best to go to a lawyer that specializes in Bankruptcy. They will give you a packet to fill out. Then go back and get a free consultation.

You can petition for your own Bankruptcy for £1 if you want to - providing that you are insolvent - this means that your financial worth, including all your assets, don't add up to more than £1.

A creditor can make you bankrupt only if you owe £750 or more.

You need to pay a fee of £495, which may be reduced if you are receiving certain benefits. However, bankruptcy is a last resort option to deal with your debts - and you should get professional advice before going ahead (contacts below).

No-one should tell you that you shouldn't petition for bankruptcy for the £4000 that you owe - for all we know, you may be suffering from incredible stress, feeling emotionally distraught and are therefore unable to find or cope with another way forward.

You should know however, that there are alternatives, and that the following free debt organisations can help you if you get in touch:

Finally, when you say that the creditor won't accept £5 per month, you need to understand that they don't have to accept it - if that is all you can offer them, then that's all you pay - make sure you pay your priorities first - rent/mortgage, council tax, food, utilities - this is where a free debt advice organisation can give you the right tools and support to be strong with your creditors.

you cannot go bankrupt for only 4000

sounds to me like you are dealing with debt collectors, not bailiffs. debt collectors can do nothing other than hassle you, which is illegal if it becomes harrassment.

I believe there is some legislation that says if you have made an offer and can prove that is all you can afford then the courts will force them to accept it. Try spouting that at them see if they will take the £5 a week then.

I filed for bankruptcy on my own, without a lawyer. But keep in mind it was quite a bit of paperwork to do! I'm not sure what the debt amounts need to be these days, but there is a TON of information at Nolo Press. Try this link:

Also, the laws vary from state to state, so you need to find out your own state requirements. But the Nolo Press bankruptcy information is a really great place to start.

First off try to do anything but file for bankruptcy. I am currently working for a bankruptcy attorney in Colorado and it cost about $1,800.00 just to file, with the company I work for he requires half now, then the remainder 30 days after filing. But the price can go up. Also figure out which chapter you want to file. Chapter 7 is a complete liquidation of all your debts and a Chapter 13 is a re-payment plan where you pay a certain amount every month for 3-5 years.

Your debts have to be over 6,000.00, some attorneys will take you if you have less but most will not. Hopefully this helps.

I suggest you look at the http://www.moneysavingexpert.com forum. Lots of advice on bankruptcy, bailiffs and how to cut costs. Also have a look at Administration Orders. This may be an option for you instead.

In UK, you apply at the local court (I expect you can do it on-line these days) - as I recall, your debts have to exceed £15,000 ...

I suggest you consult your local Citizens Advise first & then the uk.gov site ...

Be aware that a bankrupt will loose their house, even if you have no mortgage (it will be sold to pay your debts) .. if you take the IVA route to clear your debts instead, then (so long as you keep up any mortgage payments) you will get to keep your house ..

Go to a lawyer who handles bankrupty. Pay around $200 or set up a payment plan of $50 a month.

Do you know that it costs £495 to file a petition for bankruptcy with the court ? If you are unable to work due to illness, your local CAB will help you to negotiate with your creditors - offering a small token monthly payment until you are back at work. It is not worth having a bankruptcy in your credit history for just £4000. Also consider how a bankruptcy would affect your career prospects. Bankruptcies are advertised in the local press and your landlord is informed - this may break a tenancy agreement and you would lose your home.
