my husband and i baught ahouse last yr and my name isn;t on the mortage, he tried adding me to the mortage but they wouldn't add me since i didn't have a job, well now my husband is deployed and we are a little low on the payment and missed the payment, i tryed calling the mortage company to see if they could hold the payment until next week but with me not on the account they wouldn't let me have any info or nothing, i even have a power of attorney paper and they said that i could not send it cause if wasn't a sign paper from him does anyone have any idea on what i should do? |

An unsigned POA is meaningless. It would be illegal for them to talk to you, he has to call them. |

The IRS accepts those military POAs, so should the mortgage company. Tell them that if necessary, you will invoke the Sailors and Soldiers relief act. |

Try talking to someone in your husband's unit that might be at home to see if they can help. Other than that I don't know what you can do if the company won't take power of attorney information. |

Go to your husbands chain of command. Your power of attorney...if it was the one that covered EVERYTHING, not just a general should be enough. If you have access to the bank you could try that, if not talk to your husbands chain of command and they can get word to him that he needs to make a phone call. It's hard and it's really a pain, but when it involves where you live they will do anything to help. You should have Rear D's number on hand. |

I am not on our mortgage either, but I do have a job. I was always told that with Marital assets, I would get 50% of everything anyway and it didn't really matter. Nevertheless, I never thought of it in the scenario you are in. I know they will have to have him in order to change paperwork. Most people's house is their biggest assest (loan) and with the mortgage crisis the way it is now I'm sure they are being rather strict. Ask to speak to the head of department and put their answer in writing. |

Yes there are many things you can do. First of all you and your husband are covered under the Servicemembers Civil Relief Act (SCRA)

all these other ideas are good ones, however, even if your husband was right there to call, I don't believe they would be able to change anything or hold the payment either way. My husband too is deployed...it sucks...sorry...but you have a 15 day grace period (almost all do) so if this was a recent missed payment, then as long as you are able to get it in within the 15 day grace period....no sweat right? good luck, I hope this helps! |

Yes, you can contact his base's branch of the Judge Advocate General's office and secure their help. They will, I assure you, want to get involved because he IS on active duty. This clown should NOT be harassing you like this. They can assist you with this. Always know you can call his base and get the answers you need. You are NOT alone. |
