My husband has done a runner to canada recently because he owes a huge amount of money in the UK. He has dual nationaility and his parents are over there so he has gone to live with them and get a job through his dad there. I left him in December, we havent been married a year so I cannot get a divorce yet. Our house is on the market to sell. We also have a £20k loan secured against the house, which he spent the majority of, this was supposed to be used for our wedding. He stole money off of me, I have been paying the mortgage on my own since July 2007 and bills so he has not contributed anything. Yet he says he still wants the £20k deposit that he put into the house but I dont think this is fair considering what he has done. He didnt go bankrupt before he left the UK because he said he couldnt afford it so he's done a runner. The mortage company have been great but not the loan company, can they chase him for payments or what else can I do to ensure he takes responsibility? Additional Details Thanks for your advice. All we had in joint names was the mortgage and loan. The bills were in his name so I guess thats some compensation. I just wondered that if I was able to sell the house, could I ask all of it be put into my bank account or would I need his consent? I will be seeing a lawyer soon and going to the CAB. |

Focus on keeping the wolves away.
The mortgage company is not overly concerned with repayment because the proceeds of the house sale will more than cover the debt. The loan company is acutely aware that it is second in line to collect and the soured marital situation increases the risk for them.
I suggest you work back from a worse case scenario,
that he is out of the picture for the foreseeable future.
Keep tabs of receipts,debts/contracts.deeds...
Check the library for the law reference sources.
Seek legal advice (the initial consultation is usually free).
You might be able to trace him in Canada through their equivalent of the White Pages & searches on the internet . Let the lender use their resources to settle with him as much as possible. If you locate him, pass on the details for the appropriate authorities to act on.
Only you can decide if it is worthwhile using a PI to chase after him for monies owed. It's harder to resolved things outside of national borders.
Sometimes, it may be best to write the whole thing off; staying away from that POQ wolf.
Usually the size of the debt and location of where any contracts are enforced determines which court is applicable.

Write a letter to the debt company (and keep a copy) telling them this debt is nothing to do with you, and give them your hubby's address in Canada, it is up to them to chase him, not you, also put an advert in a news paper saying you are no longer responsible for your hubby's debts, put IT in an obscure paper so no one will read it, then you have done your best, and any other debts are nothing to do with you.
If anyone else gets in touch hey ho !!!! nothing to do with you. I hoped you didn't agree to the £20k loan as joint as if you did you are jointly responsible, and if this is the case go to the Courts and get them to stop any interest going on and on to the mortgage as there will be no collateral left when you sell, and tell your hubby to get a new hobby and take to hiking. good luck. |

Get a lawyer! You will need a good one, and they'll force him to pay at least 50% because you are responsible for 50% as well. He will not take responsibility on his own, so get a good lawyer and get his butt! |

My ex did the same thing, yet everything was in my name, so stuck with £20k debt! Is there any way you can use his £20k from house sale to offset the debts or does the money go straight to him? If so someone must be aware of his address! Best of luck to you hun, you sound like your better off without him!!! |
