Bankrupcy will cost you £485 (-150 if on benefits.) You will be protected from any further action from the point you are declared bankrupt. You can only get credit up to £500 whilst bankrupt usually discharged after one year, doubt you would make any payments if on benefits, will lose any valuable assets car if not necessary or worth more than about £2000 , other than that none of your household stuff is taken. If you own your own home you would lose it if there is equity in it. You should take proffessional advice first though go to cccs consumer counselling service they give free advice and will help you. As said you could wait for them to make you bankrupt but that could take ages and you will be continuously hassled by creditors also if any debt for council tax parking fines could end up with bailliffs. Better to deal with it I think. The Debt management plan mentioned is ok in the short term but interest does not have to be frozen and it can take years for the debts to be repaid . Bankrupcy if you have no job in sight may be the best solution but do get proper advice.

they cant touch your benefits because you need that to live on.

similarly they cant touch DLA because that is extra money you need to live as a disabled person. However, here is the rub. if you are working then they will claim that your DLA frees up more of your other income and so they take it into account that way.

which is why i didnt claim DLA until after my bankruptcy had finished.

See a Bankruptcy attorney. I do know for a fact you don't have to go through Chapter 13 first if the court finds that you are unable to pay.

If that were true, then everyone who had a Chapter 7, would also have a Chapter 13 converted into a Chapter 7 on their credit, and they don't.

I assume you are in england if you are on benefits then going bankrupt will make no difference your creditors cannot chase you because you are unable to pay. if they want to send you bankrupt ok but dont apply yourself it costs.
IF you own your own house it does get a little complicated but if you have no tangible assets it makes little difference

See the citizens advice bureau but if you declare your self bankrupt it would mean that if you return to work within the next 3 years you will have to start paying the money back and also you will have a very bad credit rating for 7 years.

If you go bankrupt you may leave your debts behind but only after your current assets have been liquidated and sold to pay off as much as possible to your creditors. Then you will have a long period in which you will be unable to obtain any kind of credit such as a mortgage etc.

An alternative is to go into debt counciling (Googe it) and this way your debt counciling service will negotiate a small monthly payment (maybe only a few pounds a month) with your creditors and interest will be frozen on all your debts.

Not sure, but I heard everyone has to go Chapter 13. The court supervises a monthly $100 distribution to everyone filing a claim against you. That agreement lasts for 5 years.
